ORDINANCE NO. 7614,5-ieg AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, ESTABLISHING A NONREVERTING "K-9 UNIT DEVELOPMENT FUND", AS NEW SECTION 2-170 OF THE MUNICLPAL CODE OF THE CITY OF SOUTH BEND, INDIANA STATEMENT OF PURPOSE AND INTENT: The Common Council has determined that it would be in the City' s best interest to create and maintain a fund for the purpose of aiding the operation of the K-9 Unit of the South Bend Police Department as a supplementary means of combating crime and providing protection for the citizens and property of South Bend. The Common Council has determined that it is in the best interest of the City to create a fund to receive donations to be used for the purpose of providing for the funding of a K-9 Unit of the South Bend Police Department. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND: SECTION I. Chapter 2, Article 14 of the Municipal Code of the City of South Bend, Indiana, is hereby amended by the inclusion of new Section 2-170 which shall read in its entirety as follows: Sec. 2-170. K-9 Unit Development Fund. (a) The K-9 Unit Development Fund is established by a separate dedicated fund to be used to receive monies, by way of donation. All sums of monies so collected and deposited in said separate dedicated fund shall be used solely for the purpose of development, maintenance and expansion of the K-9 Unit of the South. Bend Police Department. Monies remaining in the fund at the end of the fiscal year shall not revert to the general fund. (b) Any and all interest earned on the monies deposited in said dedicated fund shall remain in the fund. SECTION II . The City has been advised that the the trust has been set up for the benefit of our K-9 unit and the City could receive an excess of $7,000.00 in the very near future for such purposes.
