T1 /6 - AN ORDINANCE TO VACATE THE FOLLOWING DESCRIBED PROPERTY: HULL STREET RUNNING BETWEEN FRANCES AND EDDY STREET STATEMENT OF PURPOSE AND INTENT Pursuant to Indiana Code Section 36-7-3-12, the Common Council is charged with the authority to hear all petitions to vacate public ways or public places within the City. The following ordinance vacates the above described public property. n NOW, THEREFORE, BT IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, as follows: SECTION I. The Common Council of the City of South Bend, having held a public hearing on the petition to vacate the following property: Hull Street running between Frances Street and Eddy Street hereby determines that it is desirable to vacate said property. SECTION II, The City of South Bend hereby reserves the rights and easements of all utilities and the Municipal City of South Bend, Indiana to construct and maintain any facilities, including, but not limited to, the following: electric, telephone, gas, water, sewer, surface water control structures and ditches, within the vacated right-of-way, unless such rights are released by the individual utilities. SECTION III. The following property may be injuriously or beneficially affected by such vacating: Lots 12,13,14,15,16,17,18,20,21,22,23,24,25,26,27,28 SECTION IV. The purpose of the vacation of the real property is to: Construct a townhome project on the said street and the adjacent property. SECTION V. This ordinance shall be in full force and effect from and after its passage by the Common Council, approval by the Mayor. Jefferson Blvd. South Bend, IN 46617 Re: Vacation of Hull Street South Bend, Indiana Dear Mr. Matteo: At your request, on October 18, 1988, I appraised the property known as Hull Street, being 40 feet in width and 390 . 15 feet in length, running between North Eddy Street and North Frances Street, in the northeast quadrant of South Bend, Indiana. Hull Street has the appearance of an alley for the eastern one-half. The western half of the right-of-way is unimproved and does not appear to have been used for several years. Also, overhead electric and telephone lines traverses the entire length of the right-of-way. In my opinion, the only value the Hull Street right-of-way has would be the access to adjacent properties or to expand the land size of the adjacent properties. It is not reasonable to assume that this narrow strip of land would have any potential for development, particulary with the utility lines running the length of it. The real estate in the immediate area consists of fair to average homes and businesses, 40 plus years in age, and having traditionally low to fair market potential. Other than St. Joseph Medical Center' s complex one block to the west, no new development has occurred in this area in recent years. 922 E. Given the above described liabilities to this property, namely, the utility lines and the narrowness of the strip of property, its value would fall in the lower end of the range. Therefore, in my opinion, the value of the subject property being 40 feet by 390. 15 feet for 15, 606 square feet times twelve cents per square foot is $1, 872. 72, rounded to: ONE THOUSAND NINE HUNDRED ($1 , 900.00) DOLLARS ASSUMPTION AND LIMITING CONDITIONS The property rights being appraised are those of fee simple ownership. The appraiser assumes no responsibility for matters legal in nature, and does not render opinion of title, which is assumed to be marketable. Information furnished by others is believed reliable and has been verified where possible, however, this data is not warranted. The undersigned appraiser certifies that he has no interest, present or prospective, in the subject matter of this appraisal; that the amounts as shown above are, in his opinion, a fair market value of the property described herein, subject only to such exceptions as may be set out in writing above, and that no survey of the subject property has been made by him, and that he assumes that the buildings are properly located within the property lines and that the zoning regulations to which the real estate may be subject have not been violated.
