AN ORDINANCE AMENDING THE ZONING ORDINANCE
FOR PROPERTY LOCATED AT THE SOUTH SIDE OF WILSON ST., 123 FEET EAST OF THE
CENTERLINE OF IRONWOOD DRIVE
IN THE CITY OF SOUTH BEND, INDIANA
BE IT ORDAINED by the Common Council of the City of South Bend, Indiana:
Section 1. Ordinance No. 4990-68, as amended, which ordinance is commonly known
as the Zoning Ordinance of the City of South Bend, Indiana, be and the same hereby is
amended in order that the zoning classification of the following described real estate in
the City of South Bend, St. Joseph County, State of Indiana:
A PARCEL OF LAND BEING A PART OF THE NORTHWEST QUARTER OF
SECTION 8, TOWNSHIP 37 NORTH, RANGE 3 EAST, CITY OF SOUTH BEND,
PORTAGE TOWNSHIP, ST. JOSEPH COUNTY, INDIANA AND BEING MORE
PARTICULARLY DESCRIBED AS FOLLOWS:
THE NORTH 265 FEET OF LOTS 11, 12, 13 AND 14 AS SHOWN ON THE
PLAT OF JEFFERSON HEIGHTS ADDITION TO THE CITY OF SOUTH BEND,

RE: A proposed ordinance and site development plan of Garden Homes By E.L. , Inc.
to zone from "A" Residential and "B" Residential , "A" Height and Area to "A-1"
Residential , "C" Height and Area, property located on the south side of Wilson
St ., approximately 83 feet east of Ironwood Drive, City of South Bend - APC
#1244-89
Gentlemen:
The above referenced ordinance and site development plan of Garden Homes by
E.L. , Inc. was legally advertised April 5, 1989 and . The Area Plan Commission
gave it a public hearing on April 18, 1989, at which time the following action
was taken:
Upon a motion by Harold Means, being seconded by John Leszczynski and
unanimously carried, the proposed ordinance and site development plan of Garden
Homes By E.L., Inc. to zone from "A" Residential and "B" Residential, "A" Height
and Area to "A-1 Residential, "C" Height and Area, property located on the
south side of Wilson St., approximately 83 feet east of Ironwood Drive, City of
South Bend is sent to the Common Council with a favorable recommendation as
tendered. In the Commission's opinion, the proposed use would be compatible
with surrounding uses and would not have a detrimental effect on the area.
PLEASE NOTE that the Ordinance has been amended by the petitioner to include a
Height and Area designation different than that used for the Common Council 's
first reading. The amended Ordinance was the Ordinance legally advertised and
- heard by the Area Plan Commission.

Location: on the south side
of Wilson St . approximately
83 feet east of Ironwood
Drive
City of South Bend
REQUESTED ACTION: The petitioners are requesting a zone change
from "A" Residential and "B" Residential , "A"
Height and Area to "A-1" Residential , "C"
Height and Area to allow the construction of
duplex condominiums
EXISTING LAND USE: The property is currently vacant .
SURROUNDING LAND USE AND ZONING: Located to the north across Wilson Street are
single-family homes zoned "A" Residential ; to
the east are single-family homes zoned "A"
Residential; to the south is vacant land and a
parking lot zoned "B" Residential ; and to the
west are single-family homes zoned "A"
Residential .
ACCESS: Access to the site is proposed from Wilson
Street .
WATER SOURCE/SEWAGE DISPOSAL: City utilities are available to the site.
DRAINAGE: The drainage has been addressed by the
petitioner.
DATA: The total site to be rezoned is 2.02 acres.
Of that , the buildings will occupy 23,040
square feet, or 26 percent of the site; the
parking and drives will occupy 19,096 square
feet , or 22 percent of the site; and 45,855
square feet or 52 percent of the site will
remain as open space.
WETLANDS/FLOOD HAZARD: A check of the Agency's maps indicates that no
wetlands or flood hazard areas are present.
SITE PLAN: The site plan is preliminary.
AGENCY COMMENTS: The City Engineer noted that City Ordinances
require sidewalks along Wilson and concrete
approaches per City Standards.
