JOSEPH COUNTY, INDIANA STATEMENT OF PURPOSE AND INTENT A petition for voluntary annexation of approximately 23 . 56 acres located in Clay Township, St . Josep'a ; aunty, IndLLna has been filed by representatives of parties having an option to purchase 100% of territory to be annexed. It is the intent and purpose of this • ordinance to annex the territory to the City of South Bend, Indiana There be it ordained by the Common Council of the City of South Bend , Indiana as follows : SECTION I That the following described Real Estate in St. Joseph County, State of Indiana, being contiguous to the present boundaries of the City of South Bend is hereby annexed to and brought within the City of South Bend . A . parcel of land in the Southeast Quarter of the N rtheast Quarter of Section 32 , Township 38 North, Range 3 East, beginning at a point 231. feet East of the Southwest corner of said Southeast Quarter of the Northeast Quarter of Section 32 ; thence North 00° 42 ' 19" East , 1321 . 3 feet to a point on the North line of said quarter--quarter; thence North 89° 58 ' 00" East along said north line, 837 .53 feet ; thence South 00° 15 ' 41" West , 1321 .70 feet to a point on the south line of said quarter--quarter, thence South 90° 00 ' 00" West along said south line, 847. 76 feet to the place of beginning. EXCEPTING THEREFROM THE FOLLOWING A parcel of land in the Southeast Quarter of the Northeast Quarter of Section 32, Township 38 North, Range 3 East, beginning at a point 413 . 5 feet East and 810 feet north of the Southwest corner of said Southeast Quarter of the Northeast Quarter of Section 32 ; thence North 00° 42 ' 19" East, parallel with the west line of said quarter—quarter, 245 . 16 feet ; thence South 89 ° 17 ' 41 " East , 205 . 16 feet ; thence South 00° 42 ' 19" West , 245 . 16 feet; thence North 89 ° 17 ' 41 " West , 205 . 16 feet to the place of beginning. Subject to the legal rights of a public highway and any easements, covenants, or restrictions of record. • SECTION II Be it further ordained that the boundarries of the City of South Bend, Indiana are hereby declared to be extended so as to include the real estate of the above described parcel as a part of the City of South Bend, Indiana SECTION III This ordinance shall be in full force and effect from and after its enactment, approval by the mayor and legal publication. / //*__r_ M mber of the Co ipo / Council 1st READING (P- PUBLIC HEARING 2nd READING —/D �j Nl1T naps(V a PETITION FOR VOLUNTARY ANNEXATION- • • TO : COMMON COUNCIL CITY OF SOUTH BEND, INDIANA The undersigned hereby petition the Common Council of the City of South Bend, Indiana for voluntary annexation to the City of South Bend, Indiana of a certain parcel of real estate situated in St. Joseph County, Indiana and in support of which allege and affirm as follows : 1 . They represent prospective purchasers of at least 51% of the owners or the owners of at least 75% of the total assessed value of a certain parcel of land more particularly described on exhibit "A" attached hereto, which is incorporated herein by this reference as if fully set forth (hereinafter "the parcel") 2. The parcel is located in St. Joseph County, Indiana, outside of but contiguous to the City of South Bend, Indiana 3 . They desire that the parcel be annexed to the City of South Bend, Indiana by proper ordinance . 4. They agree to the voluntary annexation subject to the approval by the Common Council . The Petitioner request to rezone the parcel to Single family residential , "A" Height and Area. A primary plat , is being filed with the Area Plan Commission. If the Common Council denies the request for rezoning or, the Area Plan Commission denies the approval to subdivide the parcel as submitted, then Petetioner withdraws the Parcel from any further consideration for annexation to the City of South Bend, Indiana 5 . They affirm, under the penalities for perjury, that the foregoing statements are true. WHEREFORE, the undersigned petition that the parcel be annexed to the City of South Bend, Indiana Larr E.
