AN ORDINANCE AMENDING CHAPTER 6 OF THE
MUNICIPAL CODE OF THE CITY OF SOUTH BEND,
ENTITLED "BUILDING"
STATEMENT OF PURPOSE AND INTENT:
The Common Council for the City of South Bend has determined
that it is necessary to amend Chapter 6 of the Municipal Code of the
City of South Bend, entitled "Building," in order to provide for a
schedule of building and related permit fees that more accurately
represent the cost to the City to administer the Building Department
and to incorporate into said Chapter new and current editions of
rules, regulations and codes recognized on a state and national level
as setting forth adequate and appropriate standards for building and
related activities.
NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE
CITY OF SOUTH BEND, INDIANA AS FOLLOWS:
SECTION I . Chapter 6, Article 1, of the South Bend
Municipal Code is amended as follows:
Section 6.4. Permit Fees.

Building Code, the fees to be charged for the issuance of permits by
the Department shall be paid at the time the permit is issued.
(1)Permits issued for Aall new construction and all
alterations, repairs and remodeling shall be subject to the following

( $25 . 00) for each re-inspection made by department inspectors far
of commercial and industrial projects requiring-a-re-insgeetien-by
ali-the-building-and-utility- n9geeters.
(2.1) Fifty dollars ( $50.00) for each additional final
inspection necessitated by the failure to pass the previous final
inspection.
( 3 ) For hard surfacing of parking lots which have not
been included in the site plan for the construction project
(including new and re-paving) there will be a fee to be based on
estimated construction costs.
(4) -( 6) Reserved.
(7) The fee for a permit for banner signs shall be
five dollars ( $5. 00 ) each.
(8) Wrecking and demolition permit fees shall be as
follows:
a. Residential:
1. Ten Fifteen dollars ( $1878815.00) per
one- and two-story house, including accessory.
2. Fifteen Twenty dollars ( $15-8820. 00)
for more than a two-story house.
b. Commercial:
3 . Thirty-five Forty-five dollars
($3579845. 00) per one-story building with ten thousand one ( 10,001)
or more square feet.
c. Other fee requirements: For any building with
two ( 2) or more stories, fifty ( 50) percent of the single-story fee
to be added according to size for each story.
( 9) Change of classification of a building, one dollar
( $1 . 00) .
( 10) Installation of elevator, five dollars ( $5. 00 ) .
( 11) Installation of new billboard, twenty-five fifty
dollars ($25 788 50. 00) .
(12) Construction of sky signs:
First five hundred ( 500) square feet or fraction
thereof, ten twenty dollars ( $18 788 20.00) .
Each additional square foot above five hundred
( 500) on the readable side, twe five cents ( $782.05 ) .
( 13 ) Move any one- or two-story building over public
streets or alleys, fifty seventy-five dollars ( $5978875.00) .
( 14 ) Move any building greater than two ( 2) stories in
height over public streets or alleys, ene-handfed one hundred
twenty-five dollars ( $188788125.00) .
( 15) Move any building from one location to another on
the same property, fiveten dollars ( $579810. 00) .
(16) No permit, except for the change of classification
of building, shall be issued for a lesser fee than two
dollars( $2.00) .
(17 ) The fees for installation of a wood burning stove
are as follows:
(a) Flue ( including chimney and chimney
connector) -Five dollars ( $5. 00) .
(b) Existing masonry chimney (new flue
liner)-Five dollars ( $5.00) .
(c) Hearth extension ( fireplace stove or
fireplace insert) -Five dollars ( $5. 00) .
(d) If the work does not pass inspection, a
re-inspection fee of ten dollars( $10. 00) shall be charged for each
future reinspection of that phase of work.
(b) The fees provided in this section shall not include
permits for plumbing, heating or electrical installations covered by
other provisions of this Code or other ordinances of the City.
(c) Refunds shail-net-be-made-fer of fees paid for
permits which have been revoked for any reason, or which have expired
prior to full completion of work shall not be made; nor shall such
fee be applied to reduce the fee of any subsequent permit issued by
the Department, including any permit which may be issued for any
structure at the same location.
(d) Where a person shall unlawfully proceed to do any work
SECTION II . Chapter 6, Article 2, shall be amended as
follows:
Section 6-5. Adoption by Reference.
The following, rules, regulations and codes are hereby
adopted by reference as fully as if set forth herein to govern the
erection, construction, enlargement, alteration, repair, moving,
improving, removing, conversion, demolition, equipping, using,
occupying or maintenance of buildings and structures in the City:
(1) Indiana Building Code, 675 IAC 13-2, 13-3 and 13-4
which adopts by reference the Uniform Building Code and the Uniform
Building Code Standards, 1985 Edition.
( 2) Indiana Electrical Code, 1987 Edition ( 675 IAC 17)
originally published as ( 8 IR 1010) which identifies, amends and
incorporates therein the National Electrical Code, 1987 Edition.
( 3) Indiana Plumbing Rules Code, 19859 Edition
(675 IAC 16-1. 1) , which adopts by reference and amends the Indiana
BOCA National Plumbing Code, 7th Edition, 1985)7 Edition.
( 4) Indiana Mechanical RuiesCode, 19859 Edition,
(675 IAC 18-1. 1) , which adopts by reference and amends the Uniform
Mechanical Code, 19858 Edition.
( 5) One- and Two-Family Dwelling Code, 1986 Edition,
( 675 IAC 3-2) originally published as (7 IR 1870) which identifies,
amends and incorporates therein the Council of American Building
Official and One - and Two-Family Dwelling Code, 1987 Edition.
( 6) Indiana Energy Conservation Code, 1984 Edition,
( 675 IAC 19) originally published as (7 IR 2525) which identifies,
amends and incorporates therein the Model Energy Code, 1983 Edition.
(7) Indiana Swimming Pool Rules, 1985 Edition, ( 675
IAC 13-2) originally published as ( 5 IR 1829) under that title.
( 8) Installation and Operation of Solid Fuel Burning
Appliances, 1981 Edition, published by the International Conference
of Building Officials.
( 9) Standard for Chimneys, Fireplaces, Vents and Solid
Fuel Burning Appliances, Regulation 211, 1980 Edition, published by
the National Fire Protection Association.
(10) Indiana Standards for Permanent Installation of
Manufactured Homes, 675 IAC 3-3, originally published as ( 6 IR 1729)
under that title.
(11) General Administrative Rules-A3se-knewa-as-the
Indiana-Administrative-Beebe, 675 IAC 12 4675-IAA-12-1-and-645-1AE

SECTION IV. Chapter 6, Article 6, shall be amended as
follows:
Sec. 6-24. Permits.
(a) Required in advance. No person shall perform or
cause to be performed the installation or alteration of any
electrical wiring or equipment on or within any building, structure
or premises within the City without obtaining, in advance, a permit
from the Department.
(b) Each application for a permit for installation or
alteration of electrical wiring or equipment shall be accompanied by
fees in accordance with the schedule below:
(1) Temporary Service for Construction:

If the exact number of circuits or horsepower is
unknown at the time of the application for a permit, a permit may be
taken for the minimum amount known with new permits issued as the
extent of the work known.
(8) Illuminated signs; fees:
a. Free standing signs
shall be calculated for each face measured on the
skeleton framework at the rate of, sq-ft $ 0. 40 sq.ft.
b. Signs flat against
a building shall be calculated per square foot
measured as total area of display surface, sq:ft- 0.40 sq.ft.
c. All installations of

SECTION V. Chapter 6, Article 7, is amended as follows:
Sec. 6-36.3 . Permits.
(a) Required in advance. No person shall perform or cause
to be performed the installation of heating, ventilating, air
conditioning or refrigeration equipment or systems without obtaining,
in advance, a permit from the Department.
(b) Fees. Each application for a permit for installation
of heating, ventilating, air conditioning, and refrigeration
equipment or systems shall be accompanied by fees in accordance with
the schedule below. When the total capacity of any system in any
single installation is provided by more than one ( 1) unit, the sum of
the capacities of each unit and the total number of such units shall

Dear Ms. Puzzello,
I am attaching for filing a bill amending Chapter 6 of the South
Bend Municipal Code. The intent and effect of the bill is to amend
the fees for permits issued by the City' s building department to more
accurately reflect the cost to the City of operating the building
department and administering the Building Code. The bill also
incorporates by reference into Chapter 6 newly revised editions of
state and nationally recognized building and related codes.
