GAMMON Approved and signed by me August 18 zg 89 Mayor ORDINANCE NO. 800/- AN ORDINANCE ANNEXING TO AND BRINGING WITHIN THE CITY LIMITS OF SOUTH BEND, INDIANA CERTAIN LAND LOCATED IN CENTRE TOWNSHIP, ST. JOSEPH COUNTY, INDIANA STATEMENT OF PURPOSE AND INTENT A petition for voluntary annexation of approximately 4 acres located in Centre Township, St. Joseph County, Indiana, has been filed filed by the owners of 100% of territory to be annexed. It is the intent and purpose of this ordinance to annex the territory to the City of South Bend, Indiana. Therefore, be it ordained by the Common Council of the City of South Bend, Indiana, as follows: PARCEL 1 Part of the Northeast 1/4 of the Southeast 1/4 of Section 30, Township 37 North, Range 3 East, Centre Township, St. Joseph County, Indiana, described as follows: Commencing at the Northeast corner of the Northeast 1/4 of the Southeast 1/4 of Section 30, Township 37 North, Range 3 East; thence West on the North line of the Northeast 1/4 of the Southeast 1/4 of Section 30, a distance of 392.46 feet to the point of beginning; thence South parallel with the East line of the Northeast 1/4 of the Southeast 1/4 of Section 30, a distance of 360 . 00 feet; thence West parallel with the North line of the Northeast 1/4 of the Southeast 1/4 of Section 30, a distance of 549 .95 feet; thence North parallel with the East line of the Northeast 1/4 of the Southeast 1/4 of Section 30, a distance of 360 . 00 feet to the North line of the Northeast 1/4 of the Southeast 1/4 of Section 30; thence East on the North line of the Northeast 1/4 of the Southeast 1/4 of Section 30, a distance of 549 . 95 feet to the point of beginning. The area of the described tract is 197, 982 square feet or 4 . 545 acres . Subject to legal highways. Be it further ordained that the boundaries of the City of South Bend, Indiana, are hereby declared to be extended so as to include the real estate of the above described parcel as a part of the City of South Bend, Indiana. SECTION III . That the heretofore described parcel of real estate is located in St. Joseph County, Indiana, substantially abutting and contiguous to the City of South Bend, Indiana. 4 . That the petitioner desires that the parcel be annexed to the City of South Bend, Indiana, by proper ordinance. -2- • 5. That the undersigned petitioner agrees to the voluntary annexation subject to the approval by the Common Council of the City of South Bend, Indiana. That the undersigned petitioner requests to rezone the parcel to C Commercial . 6. That the undersigned affirm under the penalties for perjury that the foregoing statements are true. WHEREFORE, the undersigned petitioner requests that the parcels hereinabove set forth be annexed to the City of South Bend, Indiana.
