AN ORDINANCE FIXING MAXIMUM SALARIES AND WAGES OF
APPOINTED OFFICERS AND NON-BARGAINING EMPLOYEES
OF THE CITY OF SOUTH BEND, INDIANA,
FOR THE CALENDAR YEARS OF 1990, 1991 AND 1992
STATEMENT OF PURPOSE AND INTENT
Pursuant to Indiana Code Section 36-4-7-3, the Mayor fixes
the compensation of each appointive officer, deputy, and other
employees of the City. All such wages and salaries are subject to
approval of the South Bend Common Council.
NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE
CITY OF SOUTH BEND, INDIANA, AS FOLLOWS:
SECTION I . For calendar years 1990, 1991 and 1992 maximum
base salaries and wages for the following appointed officers and
employees of the City of South Bend, Indiana, shall be no more than
as listed below in this section; provided, however, that nothing
herein shall exclude the applicability of Section VII and VIII of
this ordinance, should the events set forth herein occur.

SECTION II. SICK LEAVE. Sick leave will be accrued at the
rate of eight ( 8) days per year, to be calculated at 2/3 day for each
month of completed employment. Employees hired prior to December 31,
1986 may maintain sick time accumulated. Effective January 1, 1987
their maximum allowable accrual will be sixty-five ( 65) days.
Employees hired after January 1, 1987 will accrue sick leave at the
rate of eight ( 8) days per year, or 2/3 day per month, with a maximum
allowable accural of forty-five ( 45) days.
SECTION III. HEALTH CARE INSURANCE COMMITTEE.
The Health Care Insurance Committee shall continue to
operate in an advisory capacity to and under the direction of the
City Controller. This Board shall be composed of representatives of
each bargaining unit, together with representatives of non-bargaining
employees within the City of South Bend. It shall be the
responsibility of the Board to review, under the direction of the
City Controller, on a regular basis the activities of the City' s
Health Care Insurance Program.
SECTION IV. ACCIDENT AND SICKNESS INDEMNITY.
A. ILLNESS OR DISABILITY. An employee will be paid short
term disability benefits of one hundred dollars ( $100.00) per week
for a maximum of seventeen (17) weeks beginning at the later of the
date following the date on which all accrued sick leave is exhausted
or the 16th day of illness or disability. Long term disability
benefit coverage will provide eligible employees with disability
benefits in an amount equal to sixty percent ( 60%) of an employee's
monthly compensation, but said sum shall not be in excess of One
Thousand Dollars ($1000. 00) per month. The eligibility and terms and
conditions of the long-term disability program shall be contained in
a pamphlet which shall be distributed to each officer and employee.
B. HEALTH INSURANCE.
1. Employee contribution. The contribution by employees for
single health insurance coverage for the self funded insurance
program of the City of South Bend shall be ten dollars ( $10.00) in
plan year 1990. The contribution for dependent coverage shall be
Twenty-one and 98/100 dollars ( $21. 98) in plan year 1990. The
monthly employee contribution for both single and dependent coverage
in plan years 1991 and 1992, shall include an additional charge of
twenty percent ( 20%) of any premium increase charged for that
respective plan year.
2. In an effort to control health care costs, the City' s
current health insurance package shall be modified beginning with the
1990 plan year to provide a program containing comprehensive major
medical health insurance that includes a $500 annual deductible and
subject to an 80/20 coinsurance payment to a limit of $1200 per year
excluding any fee charged in excess of the then prevailing rates of
medical services as established by the Health Insurance Carrier for
the City of South Bend.
3 . Cafeteria Plan Contribution. The City shall contribute
Five Hundred Dollars ( $500. 00) to each employee' s individual health
spending account. The contribution shall be made annually on the
first Monday of the plan year. This amount will be prorated for
qualifying part-time employees.
4 . The City shall pay Thirty Dollars ( $30. 00) per month to any
employee who elects to leave the City' s insurance program to be
covered by another program for which the City makes no contribution.
This election shall not be mandatory and the employee may return to

5. Life Insurance. The City shall provide term life insurance
coverage in the amount of Ten Thousand Dollars ( $10,000.00) for each
officer or employee. Such insurance shall be effective upon the
award of a group life insurance bid by the Board of Public Works or
the beginning of the plan year, whichever is later.
SECTION V. VACATIONS. Vacations shall be earned as set
forth below:
A. All city officers and employees who were employed by the
City on December 31, 1986, and have been employed continuously since,
shall be subject to the following vacation schedule for 1990, 1991
and 1992:

B. All other city officers and employees shall be subject
to the following vacation schedule for 1990, 1991 and 1992:

SECTION VI . HOLIDAYS. The Board of Public Works shall
determine the holidays to which officers and employees shall be
entitled. Officers and employees shall receive ten ( 10) holidays per
year; nine ( 9) of those holidays shall be as designated by the Board
of Public Works and the remaining one ( 1) holiday shall be as
selected by the officer or employee, with the consent of the
employer, from the following non-designated holidays:
Washington' s Birthday
Lincoln' s Birthday
Martin Luther King' s Birthday
Columbus Day
Employee' s Birthday
SECTION VII. MERIT BONUS. The maximum sum of Fifty
Thousand Dollars ($50,000. 00) in 1990, One Hundred Thousand Dollars
($100,000.00) in 1991, and One Hundred Fifty Thousand Dollars
( $150,000. 00) in 1992 shall be made available for the payment of
merit bonuses for non-probationary, non-bargaining, non-temporary
employees occupying positions normally requiring 600 or more hours of
service per year. Said amount shall be allocated among the various
City Departments in accordance with the specified percentage of the
total salaries for all qualifying employees within each department as
of October 15 of each year. That specified percentage shall be 0. 5%
in 1990, 1. 0% in 1991, and 1. 5% in 1992.
The money allocated to each department may be awarded to
for merit bonus awards. All employees receiving merit bonuses must
be on active status on the distribution date. Any merit bonus money
which is not distributed to employees on the distribution date shall
revert to the appropriate City fund.
SECTION VIII. LOCAL OPTION INCOME TAX. In the event that a
Local Option Income Tax becomes effective and tax income from Local
Option Income Tax is received by the City of South Bend in 1991 and
1992, each employee shall receive a one percent (1%) increase to
their base salary in 1992.
SECTION IX. This ordinance shall be in full force and
effect from and after its passage by the Common Council and approval
by the Mayor.

Dear Council Members:
The attached bill would establish salary and benefits for all
non-bargaining City employees for the next three years.
The formula for salary increases for full-time employees
includes base increases of 1% + $560 in 1990, 2% + $280 in 1991,
and 3% in 1992. In addition a merit bonus pool of 1/2% in 1990, 1%
in 1991, and 1 1/2% in 1992, will be established to provide bonus
compensation for employees based on performance. The City will
create a merit bonus policy to assist managers in implementing a
fair plan for all non-bargaining employees. There have also been
salary adjustments made to some 60 positions to remedy some past
inconsistencies, as well as better compensate employees for their
responsibilities with a 3 year program. The health insurance
program will be revised for 1990 to try and gain greater control
over spending costs, and full-time employees will receive $500 per
year in their individual cafeteria plans.
Part-time non-bargaining employees will receive compensation
that is proportionate to the package for full-time employees.
This proposal is within the financial guidelines established
for us through the collective bargaining process with the FOP and
Teamsters this year, and the Firefighters last year. The cost of
this package will average about 3. 5% over the next three years.
We have attempted to provide a fair compensation package for
our employees under the constraints of our financial situation.
This will permit us to plan ahead as a City, and at the same time
provide some security for our great municipal workforce.
