RESOLUTION NO. 0006-2020
A RESOLUTION OF THE CITY OF SOUTH BEND, INDIANA
BOARD OF PARK COMMISSIONERS
AUTHORIZING STAFF TO ENTER INTO PARTNERSHIP AGREEMENTS WHEREAS, the Board of Park Commissioners (“Board”) is a contracting body of the Venues, Parks & Arts Department (“VPA”) of the City of South Bend (the "City") and exists and operates under the provisions of I.C. 36-10-3 et seq., as amended from time to time (the
"Act"); and
WHEREAS, pursuant to I.C. 36-10-3-11(1), the Board is authorized to enter into
contracts for the use of facilities and services; and
WHEREAS, pursuant to the I.C. 36-10-3-11(9), the Board is permitted to delegate authority to perform ministerial acts in all cases except where final action of the Board is necessary; and WHEREAS, the Board would like to delegate effectuating partnership agreements with non-profit organizations to enhance the programming available to South Bend community. NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF PARK COMMISSIONERS:
1. The Board authorizes the Executive Director of VPA or his/her designee to
effectuate partnership agreements on behalf of the Board.
2. The authority conferred under this agreement is limited to partnerships that do not
involve the sale or lease of real property nor of a property interest in real property.
3. The authority conferred under this agreement extends to partnership arrangements
where the monetary consideration paid by the VPA, if any, is no more $ ________________________.
4. VPA will report and provide details of any partnership agreements entered into by the VPA Executive Director or his/her designee at the next Board meeting
following execution of the agreement(s).
5. This Resolution shall be in full force and effect upon its adoption by the Board of
Park Commissioners.
