'7-1 'i -dm / AN ORDINANCE ANNEXING TO AND BRINGING WITHIN THE CITY LIMITS OF SOUTH BEND, INDIANA CERTAIN LAND LOCATED IN CENTRE TOWNSHIP, ST. JOSEPH COUNTY, INDIANA STATEMENT OF PURPOSE AND INTENT A petition for voluntary annexation of approximately 4 acres located in Centre Township, St. Joseph County, Indiana, has been filed by the owners of 100% of territory to be annexed. It is the intent and purpose of this ordinance to annex the territory to the City of South Bend, Indiana. Therefore, be it ordained by the Common Council of the City of South Bend, Indiana, as follows SECTION I. That the following described real estate in St. Joseph County, State of Indiana, being contiguous to the present boundaries of the City of South Bend is hereby annexed to and brought within the City of South Bend. That part of the Northeast quarter of Section 30, T. 37 N. , R. 3 E. , Centre Township, St. Joseph County, Indiana which is described as: Beginning at a Point on the East and West quarter line of said Section which is West (assumed bearing) , 1052.30 ft. from the East quarter Post of said Section; thence West along said line and the Centerline of Ireland Road, 273.10 ft. to the Southwest Corner of the East half of the Northeast quarter of said Section; thence N. 00°00 '47" E. along the West line of the East half of the Northeast quarter of said Section, 655.06 ft. (657.25 ft. , record) to an existing Iron Pipe; thence East parallel with the East and West quarter line of said Section, 273.10 ft. ; thence S. 00 °00 '47" W. , 655.06 ft. (657.25 ft. , Record) to the Point of Beginning. Subject to the legal rights of a public highway and any ease- ments, covenants or restrictions of record . SECTION II. Be it further ordained that the boundaries of the City of South Bend, Indiana, are hereby declared to be extended so as to include the real estate of the above described parcel as a part of the City of South Bend, Indiana. SECTION III . This ordinance shall be in full force and effect from and after its enactment, approval by the Mayor and legal publication. That the undersigned represents that they are the title holders of part of and option holders for the remainder of the hereinbefore described real estate and that the undersigned have authority as owners and option owners to file this petition for voluntary annexation. 3. That the heretofore described parcel of real estate is located in St. Joseph County, Indiana, substantially abutting and contiguous to the City of South Bend, Indiana. 4. That the petitioner desires that the parcel be annexed to the City of South Bend, Indiana, by proper ordinance. 5. That the undersigned petitioner agrees to the volun- tary annexation subject to the approval by the Common Council of the City of South Bend, Indiana. That the undersigned petitioner requests to rezone the parcel to C Commercial. 6. That the undersigned affirm under the penalties for perjury that the foregoing statements are true. WHEREFORE, the undersigned petitioner requests that the parcels hereinabove set forth be annexed to the City of South Bend, Indiana.
