AN ORDINANCE OF THE COMMON COUNCIL
OF THE CITY OF SOUTH BEND, INDIANA
AMENDING ARTICLE 4 OF CHAPTER 13
OF THE SOUTH BEND MUNICIPAL CODE
ENTITLED "OFFENSES AGAINST PUBLIC
PEACE AND SAFETY"
STATEMENT OF PURPOSE AND INTENT
Section 13-57 of the South Bend Municipal Code prohibits creation
of any loud, raucous, improper, unreasonable, offensive or unusual
noise which disturbs the peace or safety of persons within the City
of South Bend. Although the ordinance is complete as to its
enumeration of prohibited noises and activities, it is incomplete to
the extent it prescribes no penalty for violation of the ordinance.
The purpose and intent of this bill is to prescribe a fixed penalty
to be assessed for violation of Section 13-57 of the South Bend
Municipal Code.
NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY
OF SOUTH BEND, INDIANA, AS FOLLOWS:
Section I . Article 4 of Chapter 13 of the South Bend Municipal
Code is amended to add a new Section, Section 13-57.05, which shall
read as follows:
Section 13-57.05. Violation; penalty. Any person
violating any provision of this section shall be
fined in the amount of fifty dollars ( $50.00) ,
payable through the ordinance violation bureau.
Each response by any enforcement officer shall
constitute a separate offense punishable by a
separate fifty dollar ( $50.00) fine.
Section II . This ordinance shall be in full force and effect
upon passage by the Council, approval by the Mayor, and legal
publication.

Re: An Ordinance Amending Section 13-57 of the South Bend
Municipal Code
Dear Mr. Zakrzewski:
I am attaching, for filing, an ordinance amending Section 13-57
of the South Bend Municipal Code.
Section 13-57 of the Code prohibits the creation or sufferance of
loud and raucous noises within the City. No particular penalty is
specified for violation of Section 13-57. The ordinance I am filing
establishes a penalty of $50 .00 for each violation of Section 13-57.
I note that such a penalty is already listed on the schedule of fines
payable through the ordinance violation bureau.
