GAMMON Approved and signed by me September 25 i9 90 Mayor ORDINANCE NO. 3/d S)'go AN ORDINANCE OF THE SOUTH BEND COMMON COUNCIL APPROPRIATING FUNDS FROM THE CUMULATIVE CAPITAL IMPROVEMENT FUND STATEMENT OF PURPOSE AND INTENT The Common Council of the City of South Bend and Board of Public Works of the City of South Bend, having expressed their interest in acquiring the property of 1045 W. Sample Street, South Bend, Indiana, for use, after modification, as a centralized vehicle maintenance facility, and appraisals of said real property having been made and filed with the Board of Public Works and the Common Council, and an offer to purchase said real property for $580,000 having been executed by the Board of Public Works at its August 27, 1990 meeting and approved by the Common Council at its September 10, 1990 meeting, and the Common Council of the City of South Bend, Indiana having transferred to the City' s Cumulative Capital Improvement Fund, the monies necessary to fund such purchase, and all statutory requirements having been satisfied, the Common Council of the City of South Bend hereby determines it is in the best interest of the City that funds necessary to purchase said real property be appropriated from the Cumulative Capital Improvement Fund. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AS FOLLOWS: Section I . The amount of $580,000.00 shall be and hereby is appropriated in 1990 and ordered set apart out of the indicated account within the Cumulative Capital Improvement Fund (CCIF) , for the indicated cost of purchasing the real property at 1045 W. Sample Street, pursuant to the "Agreement to Purchase" executed by the Board of Public Works of the City of South Bend on August 27, 1990, and approved by the Common Council at its September 10, 1990 meeting: Fund Account Amount 407 04412.00 - Real Estate Purchases $580,000.00 Total Expenses $580,000.00 Section II. This ordinance shall be in full force and effect from and after its approval by the Common Council and approval by the Mayor. The purpose of this Ordinance . is to appropriate money for the municipal services facility. Additionally, prior to the September 24, 1990 Council meeting we will be filing the following two Resolutions: (1) A Resolution authorizing the temporary transfer of idle funds of the City of South Bend, Indiana from various funds to various funds within the Civil City of South Bend, Indiana. (2) A Resolution approving the purchase of real property. It will be necessary to place these two Resolutions under the "special business" portion of the Council agenda. We are requesting this in order to have all relevant actions occur on the same evening. Prior to this meeting, there will also be an informal Council meeting where we can discuss this proposal in greater detail. We are pleased at the prospect of acquiring the National Mill Building. As you know, we have had numerous problems with the current facility and have been evaluating alternatives for space to accommodate the operation. I will be happy to answer any questions you or other members of the council may have.
