GAMMON Approved and signed by me L-hlan,o.h ) 9 -/ t Mayor ORDINANCE NO. g0-70-'90 AN ORDINANCE TO VACATE THE FOLLOWING DESCRIBED PROPERTY: The second east-west alley, north of Hildreth Street, running east from Esther Street, for a distance of approximately 120 feet to: the west line of an existing. 16 foot alley in the recorded plats of Bellevue and John Adams first addition; also the first east-west alley north of Hildreth Street, running east from Esther Street, for a distance of approximately 120 feet to the west line of an existing 14 alley in the recorded plat of Bellevue; also the first north-south alley east of Esther Street, running north from Hildreth Street, for a distance of approximately 564 feet to the south line of Ruskin Street, in the plats of Bellevue and John Adams first addition. STATEMENT OF PURPOSE AND INTENT Pursuant to Indiana Code Section 36-7-3-12, the Common Council is charged with the authority to hear all petitions to vacate public ways or public places within the City. The following Ordinance vacates the above described public property. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, as follows: SECTION I . The Common Council of the City of South Bend having held a public hearing on the petition to vacate the following property: All that part of an existing east-west 14 foot alley lying between the north line of Lots #105, 106 and 107, and the south line of Lot #104 in the recorded plat of Bellevue, said alley being approximately 120 feet in length, and including (2) platted 5' x 5' corner cuts, and containing at total of 1,705 square feet, more or less, also: commencing at a point on the intersection of the centerline of an existing 20 foot alley and the east line of Esther Street, said point being north from the intersection of the north line of Hildreth Street and the east line of said Esther Street a distance of 271.8 feet, more or less; thence easterly parallel with the north line of Lot #102 in the plat of Bellevue, on and along said alley centerline, a distance of 120 feet, more or less to the west line of an existing north/south 16 foot alley. Said description includes all property lying 10 feet either side of the above described centerline and containing 2,400 square feet, more or less, also: commencing at the northwest corner of Lot #4 in the plat of John Adams first addition, said point also being the intersection of the south line of Ruskin Street and the east line of Esther Street; thence easterly along said south line of Ruskin Street a distance of 128 feet, more or less to the centerline of an existing 16 foot wide alley, the true point of beginning of this description; thence southerly along said centerline a distance of 297 feet, more or less to a point located on the original south line of Harriet Street, now vacated; thence westerly along said south line, a distance of 1 foot to the centerline of an existing 14 foot wide alley; thence southerly along said centerline, a distance of 266.8 feet to the north line of Hildreth Street, the terminus of this description, said 16 foot alley containing 4,752 square feet, and said 14 foot alley containing 3,735.2 square feet and totaling 8,487.2 square feet, more or less. SECTION IV. The purpose of the vacation of the real property is XXOt for future development. • SECTION V.
