BO57 90 AN ORDINANCE TO VACATE THE FOLLOWING DESCRIBED PROPERTY: 1st East-West alley South of Jefferson Blvd. and between St. Louis Blvd. and the 1st North-South alley East of St. Louis Blvd. Approximately 14 ' wide x 165 ' long STATEMENT OF PURPOSE AND INTENT Pursuant to Indiana Code Section 36-7-3-12, the Common Council is charged with the authority to hear all petitions to vacate public ways or public places within the City. The following Ordinance vacates the above described public property. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, as follows: SECTION I. The Common Council of the City of South Bend having held a public hearing on the petition to vacate the following property: 1st East-West alley South of Jefferson Blvd. and between St. Louis Blvd. and the 1st North-South alley East of St. Louis Blvd. Approximately 14 ' wide x 165 ' long hereby determines that it is desirable to vacate said property. SECTION II . The City of South Bend hereby reserves the rights and easements of all utilities and the Municipal City of South Bend, Indiana to construct and maintain all facilities, including, but no limited to, the following: electric, telephone, gas, water, sewer, surface water control structures and ditches, within the vacated right-of-way, unless such rights are released by the individual utilities. SECTION III. The following property may be injuriously or beneficially affected by such vacating: Lot 248 and North half Lot 249 COTTRELL' S ADDITION SECTION IV. The purpose of the vacation of the real property is to: To gain ingress and egress to parking for newly built building SECTION V. OF JEFFERSON BLVD. Dear Members of the Council: In accordance with Municipal Code Section 18-53 .8 , a favorable recommendation is being submitted to the Common Council concerning the Vacation Petition filed by Mr. Anthony George, 1102 Devon Circle, South Bend, Indiana, to vacate the following alley: 1st East/West alley South of Jefferson Boulevard and between St. Louis Boulevard and the 1st North/ South alley East of St. Louis Boulevard - approximately 14 ' wide x 165 ' long. For your information, a Public Hearing concerning the Vacation Petition as filed was held by the Board of Public Works on January 2, 1990 . Mrs. Cheryl George was present on behalf of her husband, Anthony George, Petitioner, and spoke in favor of the vacation. Mrs. George advised the Board that the Zion United Church of Christ, an adjacent property owner, has advised in writing that they have no objection to the vacation of the alley. A copy of the letter from the Church and a copy of the minutes of the Public Hearing are attached.
