AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY
OF SOUTH BEND, INDIANA, ADDRESSING THE AMOUNTS OF
BENEFITS TO BE RECEIVED BY SURVIVING SPOUSES OF
DECEASED POLICE OFFICERS AND FIREFIGHTERS
STATEMENT OF PURPOSE AND INTENT
Several Indiana Laws govern pension funds and benefits
for police officers and firefighters. More specifically the
1925 Police Pension Fund is addressed in Indiana Code
Sections 36-8-6-1 et seq. , the 1937 Firefighters' Pension
Fund is addressed in Indiana Code Sections 36-8-7-1 et seq. ,
and the 1977 Police Officers' and Firefighters' Pension and
Disability Fund is addressed in Indiana Code Sections 36-8-
8-1 et seq.
The Common Council and the City Administration have
jointly worked together, and have determined to raise the
benefits received by surviving spouses of deceased police
officers and firefighters to thirty five percent (35%) of
the salary of a first class police officer or firefighter.
NOW, THEREFORE, BE IT ORDAINED by the Common Council of
the City of South Bend, Indiana, as follows:
SECTION I. If a sworn police officer or sworn
firefighter of the City of South Bend, Indiana, dies while
in active service or after retirement, the surviving spouse
of said firefighter or police officer who dies before
January 1, 1989, shall receive thirty five percent (35%) of
the salary of a fully paid first class firefighter or first
class police officer in the respective police or fire
departments at the time of the payment of the pension. For
the surviving spouse of such a firefighter or police officer
who dies after December 31, 1988, an amount per month,
during the spouse's life, shall be equal to the greater of
thirty five percent (35%) of the monthly pay of a first
class firefighter or police officer or fifty-five percent
(55%) of the monthly benefit the deceased member was
receiving or was entitled to receive on the date the
member's death.
SECTION II. This Ordinance shall be in full force and
effect from and after its passage by the Common Council and
approval by the Mayor, with the effective date to be January
1, 1990.
