AN ORDINANCE AMENDING CHAPTER 20, ARTICLE 9
OF THE SOUTH BEND MUNICIPAL CODE,
ENTITLED "MOBILITY HANDICAPPED PARKING"
STATEMENT OF PURPOSE AND INTENT
Chapter 20, Article 9 of the Municipal Code of the City of South
Bend regulates parking places limited for use by, for, or on behalf
of mobility handicapped persons. The Common Council hereby finds an
amendment to Chapter 20, Article 9 necessary for the efficient
enforcement of mobility handicapped parking restrictions.
NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY
OF SOUTH BEND, INDIANA, AS FOLLOWS:
SECTION I . Chapter 20, Article 9, Section 20-1-1-2 of the
Municipal Code of the City of South Bend is amended to read as
follows:
Section 20-1-1-2. Designation of Handicapped
Parking Spaces.
(a) Any person on behalf of any mobility
handicapped person or authorized group
organization representing the handicapped may
request the Board of Public Works to designate a
space for handicapped parking.
(b) The Board shall refer such request(s) to the
Bureau of Traffic & Lighting for review and
recommendation.
(c) Upon the receipt of the Bureau of Traffic &
Lighting' s review and recommendation, the Board
shall either accept, modify or deny said
recommendation.
(d) Upon the Board' s designation of a space for
handicapped parking, its-respeetive-eurb-setaii-be
painted-Hue-and a sign shall be installed
bearing the words:
"HANDICAPPED PARKING ONLY
DISABLED LICENSE OR PERMIT REQUIRED
ALL OTHER VEHICLES WILL BE TOWED
AWAY AT OWNER'S EXPENSE"
and the official international wheelchair symbol or
reasonable facsimile thereof. All angle parking spaces so
designated shall be at least thirteen (13) feet wide.
SECTION II . Chapter 20, Article 9, Section 20-113 of the
Municipal Code of the City of South Bend shall be amended to read as
follows:
Section 20-113 . Penalties.
(b) Any motor vehicle found parking in areas
designated for the exclusive use of mobility
handicapped persons which does not bear a disabled
veteran registration plate, a special registration
plate, or display a South Bend handicapped parking
permit shall be fined twenty-dellafs-f$20799+
fifty dollars ( $50.00) and towed at the owner' s
expense if found in violation for longer than one
hour. Continuing violations under this section
shall constitute a separate offense and be
punishable by separate penalty for each
infraction.
SECTION III . This ordinance shall become in full force and
effect upon adoption by the Council, approval by the Mayor and proper
legal publication.

Re: Ordinance Amending Chapter 20, Article 9
of the South Bend Municipal Code
Dear Mrs. Puzzello:
I am attaching for filing an Ordinance Amending Chapter 20,
Article 9 of the South Bend Municipal Code. The effect of the
ordinance is to amend the Mobility Handicapped Parking Ordinance to
delete the requirement that the curbs adjacent to handicapped parking
spaces be painted blue. On November 6th, the City' s Board of Public
Works adopted Resolution 89-43 approving this change to the Ordinance
and authorizing the City Engineer, on behalf of the Board, to file
the attached Ordinance.
