AN ORDINANCE MAKING TECHNICAL CORRECTIONS TO ORDINANCE NO. 7998-89 FIXING MAXIMUM SALARIES AND WAGES OF APPOINTED OFFICERS AND NON-BARGAINING EMPLOYEES OF THE CITY OF SOUTH BEND, INDIANA, FOR THE CALENDAR YEARS OF 1990 , 1991 AND 1992 STATEMENT OF PURPOSE AND INTENT The purpose of this Ordinance is to make technical corrections to Ordinance No. 7998-89 fixing the maximum salaries and wages of appointed officers and non-bargaining employees of the City of South Bend, Indiana, for the calendar years of 1990, 1991 and 1992 by eliminating clerical errors and inadvertent omissions. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AS FOLLOWS: SECTION I. Ordinance No. 7998-89 is amended in its entirety as follows: SECTION I. For calendar years 1990 , 1991, 1992 maximum base salaries and wages for the following appointed officers and employees of the City of South Bend, Indiana, shall be no more than as listed below in this section; provided, however, that nothing herein shall exclude the applicability of Section VII and VIII of this ordinance, should the events set forth herein occur. SICK LEAVE. Employees hired prior to January 1, 1987 who have not elected long term disability benefits may maintain up to ninety (90) days of accumulated sick leave. Employees hired prior to January 1, 1987 who have elected long term disability benefits may maintain up to sixty five ( 65) days sick leave. Such employees who currently have in excess of sixty five (65) days accumulated leave may maintain the sick leave accumulated, however, no additional sick leave may be accrued until such time as the balance of sick leave falls below sixty five ( 65) days. Employees hired after January 1, 1987 may accumulate up to forty five ( 45) days sick leave. SECTION III . HEALTH CARE INSURANCE COMMITTEE. The Health Care Insurance Committee shall continue to operate in an advisory capacity to and under the direction of the City Controller. This Board shall be composed of representatives of each bargaining unit, together with representatives of non-bargaining employees within the City of South Bend. It shall be the responsibility of the Board to review, under the direction of the City Controller, on a regular basis the activities of the City' s Health Care Insurance Program. SECTION IV. ACCIDENT AND SICKNESS INDEMNITY. A. ILLNESS OR DISABILITY. An employee will be paid short term disability benefits of one hundred dollars ($100.00) per week for a maximum of seventeen (17) weeks beginning at the later of the date following the date on which all accrued sick leave is exhausted or the 16th day of illness or disability. Long term disability benefit coverage will provide eligible employees with disability benefits in an amount equal to sixty percent ( 60°%) of an employee's monthly compensation, but said sum shall not be in excess of One Thousand Dollars ( $1000.00) per month. The eligibility and terms and • • . B. . HEALTH INSURANCE. • 1. Employee contribution. The contribution by employees for single health insurance coverage for the self funded insurance program of the City of South Bend shall be ten dollars ($10. 00) per month in plan year 1990. The contribution for dependent coverage shall be Twenty-one and 98/100 dollars ($21. 98) per month in plan year 1990. The monthly employee contribution for both single and dependent coverage in plan years 1991 and 1992, shall include an additional charge of twenty percent ( 20%) of any premium increase charged for that respective plan year. 2. In an effort to control health care costs, the City' s current health insurance package shall be modified beginning with the 1990 plan year to provide a program containing comprehensive major medical health insurance that includes a $500 annual deductible and subject to an 80/20 coinsurance payment to a limit of $1200 per year excluding any fee charged in excess of the then prevailing rates of medical services as established by the Health Insurance Carrier for the City of South Bend. 3 . Cafeteria Plan Contribution. The City shall contribute Five Hundred Dollars ($500.00 ) to each employee's individual health spending account. The contribution shall be made annually on the first Monday of the plan year. This amount will be prorated for qualifying part-time employees. 4. The City shall pay Thirty Dollars ( $30. 00) per month to any employee who elects to leave the City' s insurance program to be covered by another program for which the City makes no contribution. This election shall not be mandatory and the employee may return to the City' s program provided that the conditions of the City' s insurance plan are met, and contributions in the amounts specified in paragraph (1) of this section are made, but such employee shall forfeit the Thirty Dollar ( $30. 00) payment per month. 5. Life Insurance. The City shall provide term life insurance coverage in the amount of Ten Thousand Dollars ( $10,000. 00) for each officer or employee. Such insurance shall be effective upon the award of a group life insurance bid by the Board of Public Works or the beginning of the plan year, whichever is later. SECTION V. VACATIONS. Vacations shall be earned as set forth below: A. All city officers and employees who were employed by the City on December 31, 1986, and have been employed continuously since, shall be subject to the following vacation schedule for 1990, 1991 and 1992: YEARS OF CONTINUOUS SERVICE DAYS OF VACATION 1 - 4 years 10 working days 5 - 7 years 12 working days 8 - 11 years 15 working days 12 - 15 years 18 working days 16 - 19 years 20 working days 20 - 24 years 26 working days 25 + 28 working days B. HOLIDAYS. The Board of Public Works shall determinetthe holidays to which officers and employees shall ,be entitled. Officers and employees shall receive ten ( 10) holidays per year; nine (9) of those holidays shall be as designated by the Board of Public Works and the remaining one ( 1) holiday shall be as selected by the officer or employee, with the consent of the employer, from the following non-designated holidays: Washington's Birthday Lincoln's Birthday Martin Luther King' s Birthday Columbus Day Employee's Birthday SECTION VII. MERIT BONUS. The maximum sum of Fifty Thousand Dollars ($50,000. 00) in 1990, One Hundred Thousand Dollars ( $100,000. 00) in 1991, and One Hundred Fifty Thousand Dollars ($150,000.00) in 1992 shall be made available for the payment of merit bonuses for non-probationary, non-bargaining, non-temporary employees occupying positions normally requiring 600 or more hours of service per year. Said amount shall be allocated among the various City Departments in accordance with the specified percentage of the total salaries for all qualifying employees within each department as of October 15 of each year. That specified percentage shall be 0. 5% in 1990, 1.0% in 1991, and 1. 5% in 1992. The money allocated to each department may be awarded to qualified departmental employees as merit bonuses in amounts determined by the Department Head and approved by the Mayor, in accordance with the City' s Merit Bonus Policy. Distribution of merit bonuses will be made on the first Friday of November that is not otherwise a regular City payday, in 1990, 1991 and 1992. Only officers and employees who are non-probationary, non-bargaining, non-temporary officers or employees occupying positions normally requiring 600 or more hours of service are eligible to be considered for merit bonus awards. All employees receiving merit bonuses must be on active status on the distribution date. Any merit bonus money which is not distributed to employees on the distribution date shall revert to the appropriate City fund. SECTION VIII. LOCAL OPTION INCOME TAX. In the event that a Local Option Income Tax becomes effective and tax income from Local Option Income Tax is received by the City of South Bend in 1991 and 1992, each employee shall receive a one percent (1%) increase to their base salary in 1992. The changes as proposed are either technical corrections or the addition of positions which were inadvertently omitted from the original ordinance. In addition, we are amending the sick-leave language and making it consistent with changes made by the Council late last year. This language serves to clarify the accumulation of sick time for non-bargaining employees.
