AN ORDINANCE AMENDING THE ZONING ORDINANCE
FOR PROPERTY LOCATED AT 4612 S. Main Street
IN THE CITY OF SOUTH BEND, INDIANA
BE IT ORDAINED By the Common Council of the City of South Bend,
INDIANA:
SECTION I . Ordinance No. 4990-68, as amended, which ordinance is
commonly known as the Zoning Ordinance of the City of South Bend, Indiana,
be and the same hereby is amended in order that the zoning classification
of the following described real estate in the City of South Bend, St .
Joseph County, State of Indiana:
A parcel of land located in the west one-half of the
southwest one quarter of Section 25, Township 37
North, Range 2 East and more particularly described
as beginning at the northwest corner of the Pleasant
View Manor Addition, thence east along the north line
of said addition, also being the centerline of
Callander Street , a distance of 466.7 feet , thence
north 50 feet along the east line of Auten's
Subdivision, an unrecorded subdivision, to the point
of beginning. Thence north 55 feet , thence east and
parallel to the north line of Pleasant View Manor
Addition, to the west right-of-way of Michigan
Street , thence south and southwesterly along said
right-of-way to a point which is east of the point of
beginning, thence west and parallel to the north line
of Pleasant View Manor Addition, to the point of
beginning. Also known as Tax Number 23-1030-1606,
St . Joseph County Indiana.

SECTION II . This ordinance shall be in full force and effect
from and after its passage by the Common Council , approval by the mayor,
and legal publication.

RE: A proposed ordinance initiated by the Area Plan Commission to zone from"A"
Residential, "A" Height and Area to "C" Commercial, "A" Height and Area,
property located at 4612 South Main Street, City of South Bend - APC #1360-90
Dear Council Members:
The above referenced ordinance of Initiated by the Area Plan Commission was
legally advertised July 5, 1990 and July 7, 1990. The Area Plan Commission at
its public hearing on July 17, 1990, took the following action:
Upon a motion by Sean Coleman, being seconded by Monte Sriver and unanimously
carried, the proposed ordinance initiated by the Area Plan Commission to zone
from "A" Residential, "A" Height and Area to "C" Commercial, "A" Height and
Area, property located at 4612 South Main Street, City of South Bend is sent to
the Common Council with a favorable recommendation. This property contains a
commercial building and has been used for commercial purposes in the past under
the assumption that it was appropriately zoned. This petition will rectify an
error in the "Books of Maps" and grant the property the commercial zoning it was
to have received in 1970.
The deliberations of the Area Plan Commission and points considered in arriving
at the above decision are shown in the minutes of the public hearing, and will
be forwarded to you at a later date to be made a part of this report.
Attached, for your consideration in the review of this matter, is a copy of the
Area Plan Commission's Staff Report.

"C" Commercial , "A" Height and Area to correct
an error in the "Book of MapsTM .
EXISTING LAND USE: The property contains a vacant commercial
building.
SURROUNDING LAND USE AND ZONING: Located to the north is a vacant lot zoned "A"
Residential ; to the east across U.S. 31 are
commercial buldings zoned "C" Commercial ; to
the south is a single-family dwelling zoned
"C" Commercial; and to the west is a vacant
lot zoned "A" Residential.
ACCESS: Access is from Main Street.
