GAMMON Approved and signed by me August. 15 �9 90 Mayor • Substitute Bill No. 17-90 Ordinance No. S/D5-q0 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AMENDING CHAPTER 21, ARTICLE 6, DIVISION 2, SECTION 21-112 COMMONLY KNOWN AS "EXCEPTIONS IN ALL DISTRICTS." STATEMENT OF PURPOSE AND INTENT The attached Bill would amend the zoning section addressing exceptions to all zoning districts within the City. The amendment would allow for-profit entities to utilize the 4-H Fairgrounds provided that they meet the same approval requirements from the Common Council and the Board of Zoning Appeals which are required for not-for-profit organizations. It is believed that this Bill is in the best interests of the City of South Bend. NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of South Bend, Indiana as follows: SECTION I: Chapter 21, Article 6, Division 2, Section 21-112 (a) (6) (A) of the Municipal Code of the City of South Bend, Indiana, is hereby amended to read in its entirety as follows: (6) Fairs, displays, shows, carnivals, circuses, and exhibits. Committee the above named Bills. of the Whole Bill No. 17-90, sponsored by Council Member Slavinskas, has been amended by maintaining Stephen Luecke "Provided that" in paragraph (6) of Section I. and First District maintaining " (A) " and underlining " (Reserved) " in that same paragraph. Donald Niezgodski Second District Bill No. 32-90, sponsored by Council Member Puzzello, has been amended in the Statement of William Soderberg Purpose and Intent by deleting "requirements" in Third District line 6 of paragraph 2 and by addin g "above ground" Ann Puzzello in line 7 before "swimming. " Fourth District All other provisions of these Bills have remained Linas Slavinskas the same. Both of these Bills should be heard at Fifth District Tuesday's Area Plan Commission meeting. The Area Plan Commission at its public hearing on June 19, 1990, took the following action: Upon a motion by Joseph Serge, being seconded by Charles Landesman and • unanimously carried, the proposed ordinance initiated by Councilman Linas Slavinskas amending Chapter 21, Article 6, Division 2, Section 2-112 commonly known as "Exceptions in all Districts", is tabled indefinitely, at the request of the petitioner The deliberations of the Area Plan Commission and points considered in arriving at the above decision are shown in the minutes of the public hearing, and will be forwarded to you at a later date to be made a part of this report .
