GAMMON Approved and signed by me July 31 Ig 90 Air ,, Mayor • • • • Bill No. 57-90 Ordinance No. _g)D q 90 AN ORDINANCE FIXING THE ANNUAL PAY AND MONETARY FRINGE BENEFITS OF FIREFIGHTERS OF THE SOUTH BEND FIRE DEPARTMENT FOR THE CALENDAR YEARS 1991, 1992,AND 1993. STATEMENT OF PURPOSE AND INTENT The South Bend Common Council has the responsibility for fixing by ordinance the annual compensation of all members of the Fire Department pursuant to Indiana Code Section 36-8-3-3 (d). A City Negotiating Team was authorized by the South Bend Common Council, Board of Public Safety, and the City Administration to negotiate on behalf of the City all pay and monetary fringe benefits for members of the Fire Department. The City Negotiating Team and the Wage Committee of the South Bend Firefighters Association, Local No. 362, reached tentative agreement on all pay and monetary fringe benefit issues on July 27, 1990. The South Bend Firefighters Association, Local No. 362, voted on the City's final offer addressing wages and benefits, and accepted the City's final offer. The following Ordinance sets forth the specific information of the City of South Bend's accepted wage and benefit offer. It is believed that this package is the best possible wage and benefit package for members of the South Bend Fire Department which the City of South Bend can afford. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, as follows: SECTION I. DESIGNATION OF OFFICERS AND SWORN MEMBERS. (a) The South Bend Common Council recognizes the Wage Committee of the South Bend Firefighters Association, Local No. 362, as the sole bargaining unit for the annual pay and monetary fringe benefits which are addressed herein for sworn members of the South Bend Fire Department, excluding the Fire Chief, Assistant Chiefs, and Battalion Chiefs for 1991, 1992, and 1993. (b) The Fire Chief, Assistant Chiefs, and Battalion Chiefs of the South Bend Fire Department are hereby designated as "Officers" in this Ordinance. SECTION II. ANNUAL PAY BASED ON RANK. (a) Annual pay for the Officers and other Sworn Members of the South Bend Fire Department,by rank, for calendar years 1991, 1992, and 1993 shall be as follows: Specialists 25,469 26,219 27,399 Captains 25,119 25,869 27,033 Engineer 23,869 24,619 25,727 Firefighter 1st Class 20,369 20,869 21,912 Firefighter 17,919 18,419 19,248 Firefighter Probationary (b) The following sets forth the service requirements of the following ranks: 0-1 year Probationary 1-2 years Firefighter 2-3 years Firefighter 1st Class (c) In the event that local option income tax is adopted in 1991, Three Hundred Dollars ($300.00) may be paid to each rank over its listed salary base in 1993 but in no event shall it be attributable to the base for pension purposes. SECTION III. OVERTIME,RECALL,AND SPECIALTY PAYS. (a) Overtime and Recall. Any Sworn Member of the South Bend Fire Department who is required to work overtime or who is recalled, shall be paid at the rate of one and one-half (1 1/2) times his or her normal rate of pay. (b) Specialty Pays. (1) The following Specialty Pays shall be paid the following amounts which are based on the specified percentage of the Engineer Rank for the year indicated. For reference purposes, the dollar equivalency is also provided for informational purposes: (i) Drivers Pay (2%): For regularly assigned drivers of fire trucks and other heavy equipment and the personnel assigned to drive ambulances (excluding those firefighters participating in the City's Private Ambulance Service Program) on regular or rotation basis: 1991 1992 1993 $477 $492 $515 (ii) Scuba Divers (2.5%): For regularly assigned scuba divers: 1991 1992 1993 $597 $615 $643 (iii) Paramedics (5.5%): For sworn members performing paramedic duties: 1991 1992 1993 $1,313 $1,354 $1,415 (iv) Hazmat (3.0%): For regularly assigned members of the Hazardous Materials Handling Team: 1991 1992 1993 $716 $739 $772 (2) The following Specialty Pays shall be paid the following dollar amounts for the years indicated: (i) Emergency Medical Technician (EMT): For persons certified by the State of Indiana as an Emergency Medical Technician: 1991 1992 1993 $350 $350 $350 (ii) Reserve Paramedic: In the event that the Fire Chief creates the position(s) of Reserve Paramedic which individual would have served as a Paramedic with the South Bend Fire Department for at least three (3) full years: 1991 1992 1993 $350 $400 $425 (c) Pro-Rated Specialty Pays. All Specialty Pays whether paid on a percentage basis or dollar basis which are addressed in paragraph (b) herein shall be pro-rated to the date of regular assignment for such special duty or duties and paid accordingly. (d) Holiday Pay. (1) All Officers and Sworn Members of the South Bend Fire Department shall be paid the sum of Six Hundred Dollars ($600) Holiday Pay gross for the calendar years 1991, 1992, and 1993. Such Holiday Pay shall be paid in four (4) equal installments of One Hundred Fifty Dollars ($150.00) gross each, payable on or about March 15, June 15, September 15, and December 15 of each year. The Holiday Pay shall be paid to each Officer or Sworn Member regardless of whether the specified holidays designated by the Board of Public Safety are worked. (2) All Holiday Pay shall be pro-rated from the date of appointment to the department. All Holiday Pay shall be pro-rated to the date of termination of employment for all qualifying Officers and Sworn Members. (e) Clothing Allowance. (1) Commencing with their second service year Officers and Sworn members shall receive the following annual clothing allowances: 1991 1992 1993 $900 $950 $950 • • (2) Said Clothing Allowance shall be paid by the City of South Bend in four (4) equal payments payable on or about March 15, June 15, September 15, and December 15, of each year. (3) All of the above described Clothing Allowance shall be pro-rated to the date of termination of employment for all qualifying Officers and Sworn Members. SECTION IV. INSURANCE BENEFITS. (a) Firefighters Contribution for Health Insurance. The contribution by Officer and Sworn Members by the South Bend Fire Department for single health insurance coverage for the self-funded insurance program of the City of South Bend shall be Ten Dollars ($10.00) per month in plan years 1991, 1992, and 1993. The contribution for dependent coverage shall be Fifty Dollars ($50.00) per month in plan years 1991, 1992, and 1993. (b) Comprehensive Major Medical Insurance. In an effort to control health care costs, the City's current health insurance package shall be modified beginning with the 1991 plan year to provide a program for Officers and Sworn Members of the South Bend Fire Department containing comprehensive major medical insurance which includes a Five Hundred Dollar ($500.00) annual deductible and which shall be subject to an 80/20 coinsurance payment to a maximum of Twelve Hundred Dollars ($1200.00) per year excluding any fee charged in excess of the then prevailing rates of medical services as established by the health insurance carrier for the City of South Bend. (c) Cafeteria Plan Contribution. The City of South Bend shall contribute Five Hundred Dollars ($500.00) to each Officer's and Sworn Member's individual health spending account. (d) Election to Leave the City's Insurance Program. The City of South Bend shall pay Thirty Dollars ($30.00) per month to any Officer or Sworn Member of the South Bend Fire Department who elects to leave the City's insurance program to be covered by another program for which the City makes no contribution. This election shall not be mandatory and the Officer or Sworn Member may return to the City's program provided that the conditions of the City's insurance plan are met and contributions specified in paragraph (a) herein of this Section are made, but such Officer or Sworn Member shall forfeit the Thirty Dollar ($30.00) payment per month. (e) Life Insurance. The City of South Bend shall provide term life insurance coverage in the amount of Ten Thousand Dollars ($10,000) to each member of the South Bend Fire Department. SECTION V. VACATIONS. The following Vacation Schedules, based on years of service, are recommended to the Board of Public Safety for approval: (a) 8-Hour Fire Personnel. All eight (8) hour Fire Personnel shall have comparable vacation time as 8 hour personnel in the Police Department with the same date of hire. (b) 24-Hour Fire Personnel. Officers and Sworn Members working twenty- (Take effect in 1991) Years of Service Days of Vacation 0-1 year 1 working day 2-3 years 4 working days 4-5 years 5 working days 6-10 years 6 working days 11-15 years 8 working days 16-19 years 10 working days 20 years &up 11 working days (Take effect in 1992 & 1993) Years of Service Days of Vacation 0-1 year 1 working day 2-3 years 4 working days 4-5 years 6 working days 6-10 years 7 working days 11-15 years 9 working days 16-19 years 10 working days 20 years &up 12 working days (c) Officers and Sworn Members working twenty-four (24) hour shifts, hired before December 31, 1986, shall be entitled to vacations pursuant to the following schedule for years 1991, 1992, and 1993. Years of Service Days of Vacation 0-1 year 3 working days 2-5 years 6 working days 6-10 years 8 working days 11-15 years 11 working days 16-20 years 12 working days 21 years &up 13 working days SECTION VI. SICK LEAVE BUY-BACK PROGRAM. (a) Officers or Sworn Members hired before December 31, 1986, working non- 24-hour shifts shall have eight (8) sick days per calendar year with a maximum accrual of one hundred (100) sick days in a sick leave bank. (b) New Sworn Members hired after December 31, 1986, and working non-24- hour shifts shall have eight (8) paid sick days each calendar year with a maximum accrual of sixty-three (63) paid sick days in a sick leave bank. (c) Officers or Sworn Members hired before December 31, 1986, working 24- hour shifts shall be entitled to five (5) paid sick days per calendar year with a maximum allowable accrual of thirty-eight (38) paid sick days. (d) New Sworn Members hired after December 31, 1986, and working 24-hour shifts shall have four (4) sick days each calendar year and shall be able to accumulate a maximum of twenty-four (24) paid sick days in a sick leave bank. _ • •• -. - -- • (f) The above terms shall be subject to the approval by the Board of Public Safety. SECTION VII. RETIREMENT SICK-DAY BUY-BACK. (a) Officers and Sworn Members of the South Bend Fire Department hired before December 31, 1986, may accumulate within a sick-day bank a maximum of nine hundred and twelve (912) hours for twenty-four (24) hour personnel, and eight hundred (800) hours for eight (8) hour personnel; both of which shall be considered a full bank for purposes of the City's Retirement Sick-Day Buy-Back Program for the South Bend Fire Department. (b) Officers and Sworn Members of the South Bend Fire Department hired after December 31, 1986, may accumulate within a sick-day bank a maximum of five hundred seventy-six (576) hours. (c) Upon a minimum of fourteen (14) days notice prior to retirement, any Officer or Sworn Member of the South Bend Fire Department may sell back to the City the number of sick days which he or she has accumulated in his or her sick bank. The rate of reimbursement shall be one-half (1/2) of the hourly rate of base pay for the 1991 Engineer Rank. (d) All payments made pursuant to the City's Retirement Sick-Day Buy-Back Program for the South Bend Fire Department shall be paid in one lump sum payment by the City on the next regular payday following the effective date of the Officers or Sworn Members retirement from the department, or as soon thereafter as possible. (e) The above terms shall be subject to the approval by the Board of Public Safety. SECTION VIII. SERVICE YEAR. The first service year for a member of the Fire Department commences upon his or her being sworn in before the Board of Public Safety as a member of that department. His or her second service year shall begin on the next succeeding first day of January. Promotion to the rank of Engineer shall be dependent upon the completion of three (3) full years of service. The Fire Chief shall forward to the Board of Public Safety the names of those firefighters eligible for the Engineer rank not later than the date they become eligible. SECTION IX. PRIVATE AMBULANCE SERVICE PROGRAM. In the event that the City of South Bend continues to contract with Memorial Hospital for neo-natal and/or pediatric transport, firefighters who volunteer to participate in the City's Private Ambulance Service Program shall receive the following compensation: (a) For calendar year 1991, the sum of Fifty Dollars ($50.00) additional pay for every shift worked, payable in the next regular paycheck, or as soon thereafter as possible. The dollar amount shall increase to the sum of Sixty Dollars ($60.00) in calendar year 1992, and to the sum of Seventy-Five Dollars ($75.00) in calendar year 1993. (b) In addition to said firefighter's regular salary and the amount set forth in 1/2) times the regular rate of pay, or comp time at the rate of One and One-Half (1 1/2) time from 7:00 AM until the firefighter returns from the run. (c) All other rules and regulations addressing the City's Private Ambulance Service Program shall be as set forth in the Collective Bargaining Agreement approved by the Board of Public Safety. SECTION X. EFFECTIVE DATE. Linas Slavinskas This Bill sets forth all of the pay and monetary Fifth District fringe benefits tentatively agreed to by both wage Thomas Zakrzewski committees late Friday evening. The South Bend Sixth District Firefighters Association, Local No. 362, met on Sunday and today and have ratified the City's Sean Coleman final offer. At Large The wage package includes $800.00 added to the Loretta Duda base in 1991 for the rank of engineer and above, At Large and $500.00 to ranks below Engineer. In 1992, John Voorde $750.00 will be added to the base for all ranks of At Large Engineer and above, and $500.00 will be added to the base below the rank of Engineer. In 1993, all ranks will receive a 4.5% increase to their base pay of 1992 except the 1st Class Firefighter rank which will have a 5% increase. Additionally, if the local option income tax is adopted in 1991, Kathleen Cekanski-Farrand $300. 00 will be added to the salary base listed in Council Attorney Y 1993 but shall not be attributable to the base for • pension purposes. All of these wage items are recommended for the Sworn Members represented by the Fire Negotiating Team. Holiday Pay is recommended to you to be increased from $544. 00 to $600.00 for 1991, 1992, and 1993 . Clothing Allowance is recommended to be increased from $799. 00 to $900.00 in 1991, $950. 00 in 1992, and $^50.00 in 1993. All Specialty Pays based on a percentage, would increase pursuant to the current established percentages based on the Engineer rank. Additionally, the EMT pay is recommended to remain at $350. 00 for all three years. A new Specialty Pay for "Reserve Medic" is recommended to be paid in 1991 at $350. 00, $400.00 in 1992 , and $425. 00 in 1993 . It is recommended that Health Insurance for the Fire Department be identical to the program adopted last year for all other City Departments. Additionally, we recommend a Retirement Sick-Day Buy-Back Program, and adjustments in Sick-Day and Vacations, however, the two-tier systems would be maintained. Monies related to the neo-natal program we recommend to be $50. 00 in 1991, $60.00 in 1992, and $75.00 in 1993 for each firefighters be per 12 hour shift volunteering for such service. This entire package is the result of countless hours of negotiations. The City Team recommends that the Common Council pass the package as presented. The City Team would like to thank the members of the Fire Negotiating Team, namely Captain Robert E. Raker, Captain David W. Yoder, Engineer Peter A. Papoi, Engineer David A.
