GAMMON Approved and signed by me Apr i 1 12 ig 9 0 Mayor ORDINANCE NO. goo? 3 - gO AN ORDINANCE AMENDING CHAPTER 21 OF THE SOUTH BEND MUNICIPAL CODE TO ADD SUBSECTIONS 21-89.5, 21-102.5 AND 21-104 .5 ENTITLED EAST BANK PARKING DISTRICT STATEMENT OF PURPOSE AND INTENT: The Council finds certain conditions exist in the East Bank Area of the South Bend Central Development Area that are uniquely detrimental to the continued development and economic viability of the East Bank Area. The intent of this ordinance is to establish certain parking requirements for certain uses within the East Bank Area of the South Bend Central Development Area: (1) To provide relief to practical difficulties and conditions that inhibit, deter or restrict the development and economic viability of the East Bank Area; (2) To recognize the planning, development and construction of over 350 public parking spaces throughout the East Bank Area; (3) To recognize and encourage shared Parking Agreements between uses within the East Bank Area; (4) To recognize and encourage private development and investments in improvements and amenities for the use and benefit of the general public with the East Bank Area; (5) To facilitate and encourage pedestrian movement within the East Bank Area; (6) To facilitate and encourage public transportation and other alternatives to single-occupant auto usage within the East Bank Area. To secure these objectives, the schedule for off-street parking spaces accessory to designated uses is provided under Sec. 21-89.5 East Bank Parking District Schedule. The East Bank Parking District is shown upon a certain map in the "Book of Maps" and in Section 21-104 .5. Such map shall be designated as. "East Bank Parking District. " NOW, THEREFORE, BE IT ORDAINED by the South Bend Common Council, as follows: SECTION I. Chapter 21 of the South Bend Municipal Code is amended by adding new subsections 21-89. 5, 21-102 .5, and 21-104 .5 which shall read as follows: ARTICLE 5. OFF-STREET PARKING A LOADING FACILITIES. Division 2. Schedules Section 21-89.5 East Bank Parking District Schedule: Off-street parking spaces accessory to designated uses shall be provided as follows: (1) Residential Uses: One and two family dwellings 1 per dwelling unit (2) Commercial Uses: Retail stores or Personal Service Establishments i per 400 sq. ft. plus 1 per 2 employees Restaurants (Except Drive-Ins) , Night Clubs, Taverns & Lounges 1 per 4 persons based on the maximum number of persons that can be accommodated at the same time in accordance with the design capacity. (3) Office Uses: Offices and Office Buildings 1 per 400 sq. ft. or 2 per 3 employees, whichever is greater Medical and Dental Clinics 5 per doctor (4) Entertainment Uses: Theaters, Auditoriums, Gymnasiums Stadiums, Arenas, Convention Halls, and Places of Assembly with fixed seats 1 per 5 seats plus 1 per 2 employees (5) Public and Quasi-Public Uses: Libraries, Museums, and Art Galleries 10, plus 1 per 500 sq. ft. over 4 ,000 sg. ft. Nursery, Elementary, and Jr. High Schools 1 per classroom and office or 1 per 15 seats in auditorium, whichever is greater Child Care, Day Care Facilities 1 per employee plus a private drop-off area. Division 3 . General Provisions Section 21-102.5 East Bank Parking District The following area is designated as the East Bank Parking District and is subject to the parking requirements established in 21-89. 5: Beginning at the point of intersection of the centerline of the first fourteen foot alley East of Hill Street and the South right-of-way line of Jefferson Boulevard; thence West along said South right-of-way line to the centerline of the St. Joseph River; thence meandering North, Northwesterly and Northeasterly along said centerline to the Westerly projection of the South right-of-way line of Corby Street; thence East along said projection and the South right-of-way line of said Corby Street to the centerline of the first 14 foot alley lying West of Hill Street; thence South along said centerline to the North right-of-way line of Crescent Avenue; thence Southeasterly to the point of intersection of the South right-of-way line of said Crescent Avenue with the centerline of the f i rci- 1A fnnt 71 1 ev foot alley lvina North of Cedar Street; thence East along said centerline to the centerline of the first 14 foot alley lying East of Hill Street; thence South along said centerline .to the place of beginning. South Bend, IN 46601 Dear Council Members: The attached proposed ordinance for your consideration and approval will create a special district to be named the "East Bank Parking District. " Within this District, certain off-street parking requirements for specifically identified uses will be established. Some of these parking requirements are different from the overall parking requirements found in Sections 21 -89 and 21 -90. This proposal is the culmination of staff study and calculation of public and private parking supply and demand within the East Bank Development Area. The objective of the proposal is to give recognition to public on-street parking developments and shared parking possibilities of future East Bank uses.
