A RESOLUTION OF THE SOUTH BEND
REDEVELOPMENT AUTHORITY
AUTHORIZING THE TRANSFER OF REAL PROPERTY TO
SOUTH BEND REDEVELOPMENT COMMISSION
WHEREAS, the South Bend Redevelopment Authority (the "Authority ") is the owner of
certain property identified herein; and
WHEREAS, pursuant to I.C. 36- 1 -11 -8, the Authority, may transfer or exchange
property with another governmental entity upon terms and conditions agreed upon by the two (2)
entities as evidenced by the adoption of substantially identical resolutions of each entity; and
WHEREAS, the South Bend Redevelopment Commission (the "Commission "), the
governing body of the South Bend, Indiana, Department of Redevelopment (the "Department ")
and of the Redevelopment District of the City of South Bend, Indiana (the "Redevelopment
District "), exists and operates under the provisions of I.C. 36 -7 -14, as amended from time to time
(the "Act ") and is a body corporate and politic; and
IL WHEREAS, the Department, by and through the Commission, has presented to the
Authority, a request for the transfer to the Commission of certain real property previously
acquired by the Authority and set forth in Exhibit "A" attached (collectively referred to as the
"Property "); and
WHEREAS, the Authority, desires to transfer the Property to the Commission for the
redevelopment purposes of the Commission; and
WHEREAS, the Department, through the Commission, will adopt a resolution consistent
with the requirement of Indiana § 36- 1 -11 -8.
NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND
REDEVELOPMENT AUTHORITY AS FOLLOWS:
1. The transfer of the following described real property situated in St. Joseph County,
Indiana:
See Exhibit "A"
by the Authority to the Commission, without consideration, shall be, and hereby is, approved and
authorized.
2. The Members of the South Bend Redevelopment Authority are each authorized,
IL respectively, to execute and attest to the execution of quit claim deeds conveying all the right,
title and interest of the Authority in and to the Property to the Commission and are further
directed to deliver said quit claim deeds to the Commission for recording in the Office of the St.
Joseph County Recorder.
3. This Resolution shall be in full force and effect upon its adoption and is subject to
the passage by the Commission of a Resolution substantially identical to this Resolution.
ADOPTED at a meeting of the South Bend Redevelopment Authority held on July 18,
2012, at 227 West Jefferson Boulevard, Room 1308, South Bend, Indiana 46601.
