AN ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA
AMENDING CHAPTER 20 OF THE SOUTH BEND MUNICIPAL CODE
ENTITLED "VEHICLES AND TRAFFIC"
STATEMENT OF PURPOSE AND INTENT
The City of South Bend from time to time utilizes the services
of specially commissioned Civil Defense Police Officers to perform
various functions, including traffic control during emergencies and
traffic control and security for special events. Although the
language of Chapter 20 of the South Bend Municipal Parking Code,
setting forth parking related regulations expressly authorizes that
only the members of the South Bend Police Department and such
entities with whom the City enters into a specific contract may
enforce parking regulations, those Civil Defense Officers holding
special police commissions during the course of their duties could
more effectively perform their duties and benefit the entire
community if they too were allowed to enforce the parking
regulations set forth in Chapter 20. Consequently, the Common
Council has determined that it is in the best interest of the City
to amend Chapter 20 to give those Civil Defense Officers who, as
part of their special police commission are authorized to enforce
Chapter 20, the legal authority to enforce this chapter when on
duty for the City of South Bend.
NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE
CITY OF SOUTH BEND, INDIANA, AS FOLLOWS:
SECTION I . Section 20-3 (a) of the South Bend Municipal Code
is amended to add a new subdivision, subdivision (n) (13 ) , which
shall read as follows:
Sec. 20-3. Authority of the Board of Public Works.
(a) The Board of Public Works shall have authority;
( 13 ) To empower those holding special police
commissions with the power to enforce the
provisions of this chapter.
SECTION II . Section 20-17 of the South Bend Municipal Code
shall be amended to add a new division, division (e) , which shall
read:
Sec. 20-17.
(e) In addition to those individuals and entities
set forth elsewhere in this section, specially
commissioned civil defense police officers of the
South Bend Police Department shall have the power
to enforce the provisions of this chapter, subject
to the conditions set forth elsewhere in this section.
SECTION III . This ordinance shall be in full force and effect
from and after its passage by the Council and .pp,.Val b e

RE: ORDINANCE AUTHORIZING CIVIL DEFENSE OFFICERS TO ISSUE
PARKING TICKETS
Dear Council Persons:
The passage of the attached ordinance is requested
after long consideration by our Department. Civil Defense
Officers who hold Special Police Commissions with the South Bend
Police Department have been very helpful in the past in many
duties, including directing traffic. Their efficiency and help-
fulness would be further enhanced if they had the power to write
parking tickets when they observe a violation of Chapter 20 in
the Municipal Code. Currently they must call South Bend Police-
men to write any parking tickets. It should be abundantly clear
that this enhanced power would enable both the specially
commissioned Civil Defense Officers to better perform their duty
and the regular South Bend Police Officers to make more efficient
use of their time.
This amendment does not modify the recently passed
amendments to Chapter 20. It is submitted separately so that it
may stand on its own merit and that the issues that it address
not be confused with those addressed by previous amendment.
