AN ORDINANCE OF THE COMMON COUNCIL OF
THE CITY OF SOUTH BEND, INDIANA APPROVING
PARKING RATES FOR PARKING GARAGES AND PARKING
LOTS OPERATED BY THE BOARD OF PUBLIC WORKS OF
THE CITY OF SOUTH BEND, INDIANA
STATEMENT OF PURPOSE AND INTENT
I.C. 36-9-11-7 authorizes the Board of Public Works to fix the
rates and charges to be collected for parking vehicles in parking
facilities owned and operated by the City and for other use of those
parking facilities so as to promote the maximum use of the facilities
by the public in a safe, orderly, and efficient manner. Such rates
fixed by the Board of Public Works are subject to the approval of the
Common Council. The Council has received Resolution No. 11-1990 of
the Board of Public Works, a copy of which is attached hereto and
made a part hereof, which establishes rates for city-owned parking
facilities, both parking garages and parking lots.
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City
of South Bend, Indiana as follows:
SECTION I . The following monthly rates shall be charged for
individual vehicles parked at the Municipal Services Facility parking
lot:
Rate
(a) Municipal Services Facility, $16.00 per mo.
SECTION II. The following monthly rates shall be charged for
vehicles parked at City operated parking garages:
Rate
(a) Per vehicle, on a month-to-month basis $40 .00 per mo.
(b) Per vehicle, on a three-year contract $43 . 00 per mo.
(c) Per vehicle, on a five-year contract $48. 00 per mo.
(d) Group rates on a monthly contract
5-49 vehicles $35.00 per mo.
50 or more vehicles $32. 00 . per mo.
(e) Priority for committing parking spaces within a City
operated parking garage shall be given to vehicles with the longest
term parking contract and the highest monthly rental rate. Commitment
of spaces within a parking garage within a particular rate structure
shall be determined based upon ( 1) the number of parking spaces
committed per single billing; ( 2) the length of time the person has
committed spaces within that garage; and ( 3) the payment experience
of the account.
Persons entering into long term agreements for parking may be
granted an option to renew within the discretion of the Board of
Public Works or its designee.
SECTION III. The following hourly rates shall be charged for

After hours/evening $ 2. 00
SECTION IV. This ,Or-dinance rescinds and supersedes all prior
ordinances: setting rates for municipal parking facilities.
SECTION V. Nothing herein shall affect rights and liabilities
accrued prior to the effective date of this ordinance.
SECTION VI . If any portion of this ordinance shall be declared
illegal or unconstitutional, that determination shall not affect the
balance thereof.
SECTION VII . This ordinance shall be in full force and effect
from and after its passage and approval by the Mayor.

Re: An Ordinance of the Common Council of the City of South
Bend, Indiana, Approving Parking Fines for Parking Garages
and Parking Lots Operated by the Board of Public Works of
the City of South Bend, Indiana
Dear Mr. Niezgodski,
I am attaching for filing an ordinance approving rates
charged at parking garages and parking lots operated by the City' s
Board of Public Works.
You will recall that the Council approved amendments to
these rates in November of last year. The ordinance I am filing
serves only to amend the charge made for after hours parking, which
previously has been referred to as the "special event" rate. All
other rates and charges remain the same.
This ordinance complements the ordinance transferring funds
within the City' s Parking Garage Fund, and the ordinance amending
Chapter 20 of the Municipal Code which I have also file today. As
with those ordinances, I am asking that the Council suspend its rules
and give this ordinance first reading and public hearing and final
reading at its March 25th meeting. The proposed rate change will be
considered by the Board of Public Works at its March 25th meeting.
