GAMMON Approved and signed by me , a -t,.0A- atil J l d 19/ D '�` &-4-,........, Mayor y • Substitute Bill No. 43-91 Ordinance No. Fa //- ?/ AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AMENDING CHAPTER 21, ARTICLE 10, "SIGN REGULATIONS" STATEMENT OF PURPOSE AND INTENT The City Ordinance addressing sign regulations provides that the intent of such regulations is ". . .to encourage creative and imaginative design and use of signs in order to create a more attractive economic and business climate. " The Ordinance further provides that such regulations are to " . . . foster and improve the economic vitality of the Community by enhancing and protecting the physical appearances of the Community. " Accordingly, the zoning provisions addressing sign regulations, focus upon the size, location, construction and manner of display of such signs. The intent of this Bill is to establish reasonable regulations with regard to the duration which political yard signs may be displayed, their size and the responsibility of timely removing such political yard signs. NOW, THEREFORE BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, as follows: SECTION I. Chapter 21, Article 10, Section 21-170 is amended by adding sub-paragraph (k) to paragraph (1) , which will read as follows: (k) Political yard signs, provided that: 1. Such signs shall not exceed five (5) square feet in display area; and not exceed three (3) feet in height nor four (4) feet in length. 2. Such signs shall be removed from the premises within fifteen (15) calendar days of the date of the primary election, and shall removed from the premises within fifteen (15) calendar days of the date of the general election. SECTION II. Chapter 21, Article 10, Section 21-173 (a) (1) is amended in part as follows: g. Directional Signs; and h. Rotation, repainting, and posting of copy; and i. Political yard signs provided they conform to the empowered to issue citation(s) for violation of this Article to the owner of sign(s) or his or her authorized agent who erected such sign(s) found in violation of this Article. A citation may be issued for each such sign found to be in violation. Such violation shall be considered an ordinary violation with a fine of twenty-five dollars ($25. 00) for the first offense, and fifty dollars ($50.00) for all subsequent offenses within the same calendar year. Such fines shall be payable through the City's Ordinance Violation Bureau. SECTION IV. Chapter 2, Article 19, Section 2-213 entitled "Schedule of Ordinance and Code Violations" (a) is amended by the addition of the following: Municipal Code Type of Code Section Violation Penalty 21-174 Sign Regulations $25. 00/$50. 00 SECTION V. Slavinskas amending Chapter 21 , Article 10, "Sign Regulations" , City of South Bend - APC #1416-91 Dear Council Members: The above referenced ordinance initiated by Councilman Linus K. Slavinskas was legally advertised August 8, 1991 and August 10, 1991. The Area Plan Commission at its public hearing on August 20, 1991 , took the following action: Upon a motion by Joseph Serge, being seconded by Willie Morgan and unanimously carried, the proposed ordinance Initiated by Councilman Linus K. Slavinskas amending Chapter 21, Article 10, "Sign Regulations", City of South Bend is sent to the Common Council with a favorable recommendation, as amended. The proposed ordinance will give the City a means of regulating political signs. The deliberations of the Area Plan Commission and points considered in arriving at the above decision are shown in the minutes of the public hearing, and will be forwarded to you at a later date to be made a part of this report . Johnson RSJ:sr Attachment Serving: South Bend, Lakeville, New Carlisle, North Liberty, Roseland & St. Joseph County, IN STAFF REPORT August 12, 1991 Initiated by Councilman Lee Slavinskas #1416-90 Amendment to the Sign Ordinance The proposed ordinance would amend the sign regulations of the South Bend Zoning Ordinance by restricting the size of political signs, limiting the amount of time that they can be displayed, and establishing the amount of fines for violating the provisions of this ordinance. The proposed amendment would restrict signs to a maximum of four square feet in size; a maximum height of three feet ; and a maximum width of four feet. Political signs could not be erected before 30 days prior to a Primary or General Election and must be remove no later than 15 days after an election. A $25.00 fine would be established for the first violation of this ordinance and $50.00 for each subsequent violation within a calendar year.
