The Zoning maps entitled "Book of Maps" Section 21-S of Chapter 21 - Zoning, Municipal code of the City of South Bend, are hereby amended by the attached map - Exhibit I . SECTION II . Ordinance No. 4990-68, as amended, which ordinance is commonly known as the Zoning Ordinance of the City of South Bend, Indiana, be and the same hereby is amended in order that the zoning classification of the following real estate labeled A on Exhibit I , is hereby established as "A" Residential , "A" Height and Area. SECTION III . Ordinance No. 4990-68, as amended, which ordinance is commonly known as the Zoning Ordinance of the City of South Bend, Indiana, be and the same hereby is amended in order that the zoning classification of the following real estate, Labeled A-1 in Exhibit I , is hereby established as "A-1"Residential , "B" Height and Area. SECTION IV. Ordinance No. 4990-68, as amended, which ordinance is commonly known as the Zoning Ordinance of the City of South Bend, Indiana, be and the same hereby is amended in order that the zoning classification of the following real estate, Labeled B on Exhibit I , is hereby established as "B" Residential , "D" Height and Area. SECTION V. Ordinance No. 4990-68, as amended, which ordinance is commonly known as the Zoning Ordinance of the City of South Bend, Indiana, be and the same hereby is amended in order that the zoning classification of the following real estate, Labeled A-3 on Exhibit I , is hereby established as "A-3" Mixed Use Multi-family Residential and Commercial , "E" Height and Area. SECTION VI . Ordinance No. 4990-68, as amended, which ordinance is commonly known as the Zoning Ordinance of the City of South Bend, Indiana, be and the same hereby is amended in order that the zoning classification of the following real estate, labeled C on Exhibit I , is hereby established as "C" Commercial , "D" Height and Area. SECTION VII . Ordinance No. 4990-68, as amended, which ordinance is commonly known as the Zoning Ordinance of the City of South Bend, Indiana, be and the same hereby is amended in order that the zoning classification of the following real estate, labeled D on Exhibit I , is hereby established as "D" Light Industrial , "E" Height and Area. JOSEPH COUNTY, IN Executive Director Room 1140 County-City Building South Bend, Indiana 46601 (219) 284-9571 June 19,1991 The Honorable Common Council City of South Bend County-City Bldg. - 4th Floor South Bend, IN 46601 RE: A proposed ordinance initiated by Councilman Sean Coleman to rezone the portion of the City of South Bend known as the West Washington-Chapin Development Area, City of South Bend - APC #1410-91 Dear Council Members: The above referenced ordinance of Councilman Sean Coleman was legally advertised June 6, 1991 and June 8, 1991. The Area Plan Commission at its public hearing on June 18, 1991 , took the following action: Upon a motion by John DeLee, being seconded by George Nome and unanimously carried, the proposed ordinance initiated by Councilman Sean Coleman to rezone the portion of the City of South Bend known as the West Washington-Chapin Development Area, City of South Bend is sent to the Common Council with a favorable recommendation. The proposed zoning plan is the culmination of over a year of study and meeting with the residents of the area. The zoning plan is in conformance with the land use plan for the area that was approved by the Board of the West Washington - Chapin Revitalization Program. The proposal would give zoning protection and control back to the people of the area. The deliberations of the Area Plan Commission and points considered in arriving at the above decision are shown in the minutes of the public hearing, and will be forwarded to you at a later date to be made a part of this report . Johnson RSJ:sr Attachment CC: Councilman Sean Coleman CC: Area Plan Commission Serving: South Bend, Lakeville, New Carlisle, North Liberty, Roseland & St. Joseph County, IN • • STAFF REPORT • INITIATED BY COUNCILMAN SEAN COLEMAN #1410-91 May 2, 1991 WEST WASHINGTON-CHAPIN DEVELOPMENT AREA This petition was initiated by Councilman Sean Coleman on behalf of the residents of the West Washington-Chapin Development Area. The area is generally bounded by William Street on the east , Olive Street on the west , a portion of Western Avenue and the Conrail Railroad tracks on the south, and the rear lot lines of the lots on the north side of LaSalle Avenue, LaSalle Court , Colfax Avenue and Orange Street on the north. The proposed zoning plan is the culmination of a comprehensive planning process lasting more than a year and including numerous meetings with the residents of the area. The zoning plan reflects both existing and proposed land uses and will help to implement the proposed land use plan for the area. Any legal uses that would become nonconforming as a result of this action would be grandfathered and could continue. The existing zoning pattern is extremely mixed and provides very little zoning protection for the residential neighborhoods in the area. This proposal would establish firm boundaries for zoning districts and help promote a more orderly development in the area. The proposal would delete the "E" Heavy Industrial zoning in the area and the "D" Light Industrial zoning in the area near the Central Business District . The plan would also reduce the number of Height and Area Districts in the area. The following zoning and Height and Area Districts are being proposed: 1. "A" Single-family Residential , "A" Height and Area 2. "A-1" One and Two Family Residential , "B" Height and Area 3. "B" Multi-Family Residential , "D" Height and Area 4. "A-3" Mixed Use, "E" Height and Area 5. "C" Commercial , "D" Height and Area 6. "D" Light Industrial , "E" Height and Area E.
