MOLNAR This is EXHIBIT K, consisting of 3 pages, referred to in and part of the Agreement between Owner and Engineer for Professional Services dated April 14, 2020,. AMENDMENT TO OWNER -ENGINEER AGREEMENT Amendment No. 1 1. Background Data: a. Effective Date of Owner -Engineer Agreement: April 14, 2020 b. Owner: Board of Public Works, Citv of South Bend C. Engineer: Abonmarche Consultants, Inc. d. Project: Howard Street Conceptual Design 2. Description of Modifications: a. The Scope of Services currently authorized to be performed by Engineer in accordance with the Agreement and previous amendments, if any, is modified as follows: Task Order # 1: Traffic Analysis i. Traffic Analysis shall include a capacity analysis of the intersection of Howard Street and Eddy Street and of Howard Street and SR 23 as requested during the development of the conceptual alternatives. ii. Review updated traffic count data provided by the City. Update the traffic analysis of these two intersection. The updated report will include an analysis of the current condition, the projected condition in 2022 following planned development, and 2040 condition including planned development and projected growth rate. Task Order # 2: Phase 1 Design i. Survey, design, special provisions and bid documents, easement or property acquisition, permitting, and bid period services of the following intersection: a. Howard Street and Eddy Street b. Howard Street and SR 23 c. Corby Boulevard and South Bend Avenue d. Notre Dame Avenue and South Bend Avenue (Topographical survey to be provided by the City) ii. Construction Administration services including review of shop drawings, attend progress meetings as requested, respond to questions as requested. Construction Administration will be performed at an hourly rate, not to exceed, as requested by the City. Abonmarche will schedule and conduct meetings with the City, University of Notre Dame, the developer, and other interested stakeholders as necessary. iii. Project coordination will be performed at an hourly rate, not to exceed, based a projected three video conference meetings, and 8 hours of correspondence and meeting preparation. Task Order # 4: Phase 2 Design i. Survey, 30% design, and traffic analysis of the intersections and connections along South Bend Avenue from Notre Dame Avenue to Corby Boulevard and the intersection of Frances Street with Campeau Street and connection to South Bend Avenue. 30% Design will include the geometric layout and intersection details with conceptual storm sewer routing. Grading and maintenance of traffic are not included in the 30% conceptual design. b. For the Additional Services or the modifications to services set forth above, Owner shall pay Engineer the following additional or modified compensation: Task Order #1: Traffic Analysis i. Traffic Analysis of Conceptual Alternatives (Hourly, NTE) $5,430 ii. Updated Traffic Analysis (Lump Sum) $6,200 Task Order # 2: Phase 1 Design i. Howard Street and Eddy Street Intersection (Lump Sum) $16,000 ii. Howard Street and SR 23 Intersection (Lump Sum) $15,800 iii. Corby Boulevard and South Bend Ave Intersection (Lump Sum) $15,900 iv. Notre Dame Avenue and South Bend Ave Intersection (Lump Sum) $17,300 v. Easement Acquisition $1,800 per parcel (Lump Sum) $5,400 vi.
