referenced amendment to extend the current terms of the Teamster Master Agreement to
December 31, 2021 and increase union employee base rate by 1%.

MEMORANDUM OF UNDERSTANDING
BETWEEN THE CITY OF SOUTH BEND AND
TEAMSTERS LOCAL UNION NO.364
This Memorandum of Understanding (this "MOU") is made on
November 17 , 2020 (the "Effective Date") and sets forth the agreement between the
City of South Bend, Indiana (the "City"), and Teamsters Local Union No. 364 , affiliated with
the International Brotherhood of Teamsters of America ("the Union") (collectively, the
"Parties").
RECITALS
WHEREAS, the Parties entered into a Master Agreement ("Agreement") to provide for
equitable and peaceful adjustment of differences which may arise, further a mutual and voluntary
effort to promote and maintain sound labor relations, and to establish other conditions of
employment for the calendar years 2017-2020; and
WHEREAS, the Common Council of the City of South Bend, Indiana ("Common
Council") passed Ordinance number 7997-89 on July 24, 1989, fixing the maximum wages and
monetary fringe benefits for Union employees of the City for the calendar years 1990 through
1992. Further, each subsequent three-year cycle, the Common Council has passed an ordinance
fixing the maximum wages for Union employees, most recently on October 24, 2016 in
Ordinance No. 10474-16 for the term commencing on January 1, 2017 through December 31,
2020.
WHEREAS, the Parties acknowledge that the full monetary impact of COVID-19 is
uncertain, but the Parties agree that the pandemic, as well as the efforts to maintain government
functions and services during the associated quarantine period will cause shortages in the City
budget for 2020 and beyond.
Wl IEREAS, the Parties plan to engage in more fully informed collective bargaining in
2021. Thus, the Parties wish to enact the clause from Article 33 of the 2017-2020 Agreement,
allowing the contract terms to "continue in full force and effect for one (1) year...," extending
the current terms through December 31, 2021.
NOW, THEREFORE, in keeping with the purpose of the Agreement to promote and
maintain sound labor relations in the best interests of the community, and in the respective best
interests of the Parties, the City and the Union agree as follows:
1. Under Article 33 of the Agreement, the current Agreement, and all of its agreed
upon supplements are in full force and effect for an additional one (1) year term. The Agreement
terms are now scheduled to expire on December 31, 2021.
2. Article 22, subsection A of the Agreement is amended to add that during the one
(1) year Agreement extension, the Union employees base rate will increase at least as much as
non -bargaining employee salaries, but not less than 1 %.
3. Article 7, subsection A of the Agreement is amended to add that in 2021, the City
of South Bend will continue paying at least 85% or more of the total budgeted cost of health
insurance.
4. This Memorandum of Understanding is effective as of the date listed above.
Every other provision of the original Master Agreement and Supplemental Agreements is
hereby ratified, approved and reaffirmed by the parties and all other matters previously agreed
to and set forth and not affected by this amendment remain in full force and effect.
