collusion or agreement with any person relative to the price to be bid by anyone at such
letting nor to prevent any person from bidding nor to induce anyone to refrain from bidding,
and that this bid is made without reference to any other bid and without any agreement,
understanding or combination with any other person in reference to such bidding. Contractor
further says that no person or persons, firms, or corporation has, have or will receive directly
or indirectly, any rebate, fee, gift, commission or thing of value on account of such sale; and

or voluntarily excluded from participation in this transaction by any Federal department or

investment activities in Iran.
a. For purposes of this Certification, "Iran" means the government of Iran and any agency
or instrumentality of Iran, or as otherwise defined at Ind. Code § 5-22-16.5-5, as
amended from time -to -time.
b. As provided by Ind. Code § 5-22-16.5-8, as amended from time -to -time, a Contractor
is engaged in investment activities in Iran if either:
i. Contractor, its successor or its affiliate, provides goods or services of twenty
million dollars ($20,000,000) or more in value in the energy sector of Iran;
or
ii. Contractor, its successor or its affiliate, is a financial institution that extends
twenty million dollars ($20,000,000) or more in credit to another person for
forty-five (45) days or more, if that person will (i) use the credit to provides
goods and services in the energy sector in Iran; and (ii) at the time the
financial institution extends credit, is a person identified on list published by
the Indiana Department of Administration.
4. Contractor does not knowingly employ or contract with an unauthorized alien, nor
retain any employee or contract with a person that the Contractor subsequently learns is an
unauthorized alien. Contractor agrees that he/she/it shall enroll in and verify the work
eligibility status of all of Contractor's newly hired employees through the E -Verify Program
as defined by I.C. 22-5-1.7-3. Contractor's documentation of enrollment and participation in
the E -Verify Program is included and attached as part of this bid/quote; and
Contractor shall require his/her/its subcontractors performing work under this public
contract to certify that the subcontractors do not knowingly employ or contract with an
unauthorized alien, nor retain any employee or contract with a person that the subcontractor
subsequently learns is an unauthorized alien, and that the subcontractor has enrolled in and is
participating in the E -Verify Program. The Contractor agrees to maintain this certification
throughout the term of the contract with the City of South Bend, and understands that the
City may terminate the contract for default if the Contractor fails to cure a breach of this
provision no later than thirty (30) days after being notified by the City.
6. Persons, partnerships, corporations, associations, or joint venturers awarded a
contract by the City of South Bend through its agencies, boards, or commissions shall not
discriminate against any employee or applicant for employment in the performance of a City
contract with respect to hire, tenure, terms, conditions, or privileges of employment, or any
matter directly or indirectly related to employment because of race, sex, religion, color,
national origin, ancestry, age, or disability that does not affect that person's ability to
perform the work.
In awarding contracts for the purchase of work, labor, services, supplies, equipment,
materials, or any combination of the foregoing including, but not limited to, public works
contracts awarded under public bidding laws or other contracts in which public bids are not
required by law, the City, its agencies, boards, or commissions may consider the

Contractor's good faith efforts to obtain participation by those Contractors certified by the
State of Indiana as a Minority Business ("MBE") or as a Women's Business Enterprise
("WBE") as a factor in determining the lowest, responsible, responsive bidder.
In no event shall persons or entities seeking the award of a City contract be required to
award a subcontract to an MBE/WBE; however, it may not unlawfully discriminate against
said WBE/MBE. A finding of a discriminatory practice by the City's MBE/WBE Utilization
Board shall prohibit that person or entity from being awarded a City contract for a period of
one (1) year from the date of such determination, and such determination may also be
grounds for terminating the contact for which the discriminatory practice or noncompliance
pertains.
6. The undersigned contractor agrees that the following nondiscrimination commitment
shall be made a part of any contract which it may henceforth enter into with the City of
South Bend, Indiana or any of its agencies, boards or commissions.

employment in the performance of this contract with privileges of employment, or any

SPECIFICATIONS FOR A 2020 OR NEWER VACUUM AIR STREET SWEEPER
It is the intent of these specifications to describe a vacuum air dual sweep street sweeper on a
conventional cab and chassis with dual steering. The unit shall be bid as a compete unit, no split
or partial bids will be accepted. Units bid shall have been manufactured in the USA. Units to be
bid with and without trade-ins. Vendor to complete bid proposal, trade-in, and
nondiscrimination commitment contained in this bid specification and attach to the submitted
bid.
These specifications are the minimum scope of the technology and performance needed for the
City of South Bend Street Sweeping Program. A responsive bidder must provide a sweeper that
meets the criteria of this specification.
Vendor shall provide all information requested in specifications to qualify for the bid. Vendor
shall indicate YES or NO for each area of the specification. Any exceptions to the following
specifications must be noted on a separate sheet and attached to the bid in order for the bid to be
valid.
The City of South Bend reserves the right to reject any and all bids which, in its judgment, will
be in the best interest of the City of South Bend.

The unit shall be awarded as a complete street sweeper.
The successful bidder will be responsible for all warranty
repairs and/or the transportation of the unit to and from
authorized warranty repair facility within 8 hours of
notification. Failure to do so will result in a $200 per
day late charge. Exceptions to this policy may be
grounds to reject a vendors bid.
Debris Hopper:
8 yard minimum capacity. High chromium stainless steel
/ NO
floor sides, roof, and door. Floor to be sloped to the
door. 6,000 square inch minimum debris filter screen,
rear dump design with hydraulic tilt and hydraulic open,
close, and lock of the rear door. Hopper to include
vibration system to help remove debris. Hopper to
include access doors on both sides for manual loading of
large debris. Hopper to include a drain to remove excess
liquid. Hopper must have adequate number of water
spray nozzles to help wash debris from the hopper when
at the dump site. Hopper to include a deluge washout
system. Unit must be equipped with debris deflector to
prevent sand blasting of the hopper interior. All
hydraulic controls to be located directly behind cab. All
openings shall be air tight by the use of rubber seals. All
sweeper hydraulics to be powered by the auxiliary
engine. Hopper to include "Hopper Full" indicator to
indicate when hopper has reached the maximum legal
weight limit of the chassis bid. To permit longer life and
lower the cost of operation, the entire debris hopper,
excluding inlet wear plate and exhaust screens, shall
carry a lifetime warranty as long as the customer owns
the sweeper. The warranty shall include, but not be
limited to, the floor, sides, roof, rear door and access
doors. The warranty shall cover rust, corrosion and
abrasion perforation, including normal wear and tear.
Manufacturer will be financially responsible for all
repairs, parts and labor, including protective coatings for
the life of the sweeper. 100% parts and labor with no
pro -rating or hour limitations. Vendor to be responsible
for all transportation of the unit for all warranty repairs.
Vendors shall supply with their bids, warranty
statements from the manufacturer in complete
compliance with the published warranty
specifications. Failure to do so will deem your bid as
non responsive.
Engine:
Power shall be supplied by a heavy-duty turbo charged,
/ NO
wet sleeved industrial diesel engine. Shall have a five
year 5,000 hour manufacturer's warranty. Engine shall
be four cylinder, four cycle, water cooled and antifreeze
protected to -40 degrees Fahrenheit. Engine shall have
115 minimum horse power, John Deere 4045T or equal.
Sweeper to have a variable working speed from engine
idle to 2,000 rpm. The engine must conform to current
EPA regulations. No exception to this environmental
legislation will be permitted. The unit shall be capable

of operating within a temperature range of -40 degrees
Fahrenheit to +126 degrees Fahrenheit with the
manufacturer's full warranty approval. Heavy duty, dry
dual element air filtration with restriction indicator and
Turbo III precleaner to be provided. Fuel system will
have a primary filter and sediment bowl as first stage
filtration from the fuel tank. Engine shall have a remote
oil pan drain with accessible drain plug to allow engine
oil to be externally drained during scheduled oil changes.
A 12 volt 65 amp alternator minimum shall be furnished
with resettable circuit breakers. High coolant
temperature and low oil pressure shutdown system shall
be supplied as standard equipment. The engine shall be
sound suppressed and pod mounted in a low profile tub.
Engine tub shall be separately mounted from the body
and shall be capable of being removed from the engine
sweeper framework by four (4) bolts. To reduce
vibration and sound, ONLY the engine, transmission and
turbine shall be "live" mounted and free floating. The
engine compartment shall be fully sealed to protect
against sound and dust contaminants. The enclosure
must be accessible without the need to raise the body or
run the auxiliary engine. The engine tub shall have
access doors to facilitate cleaning and housekeeping.
Counter -weighted latches shall be provided to keep
doors closed during normal operation and to safeguard
against ingress of debris. Engine access shall be
provided by means of permanently attached, rust free
alloy ladder with sure -grip treads. Engine shall have a
stainless steel exhaust muffler and pipe.
Engine:
Auxiliary engine fuel consumption shall not exceed 4.5

G.P.H. (gallons per hour) while producing a continuous
impeller fan speed of 3,400 RPM. Bidder shall state
engine RPM required to generate an impeller fan speed
of 3,400 RPM and related fuel consumption (gph).
Engine power output shall be adjusted by means of an
electronic, infinitely variable actuator which will provide
RPM range settings from idle to 2,000 rpm. A
tachometer and hour meter shall be supplied, standard.
Radiator shall have a sealed and dedicated air intake
duct. To ensure the air is the cleanest possible, the air
intake duct shall be located in the roof of the sweeper
engine compartment. Keyless start with integral cold
weather start air feature shall be furnished.

In -Cab
All sweeping controls shall be easily accessible to the

operator from either side driving position. `Three
Controls:
position' switches shall be supplied for gutter brooms,
nozzles and main broom. Positions one and two shall be
for raising and lowering, while position three shall
activate water system for sweep gear. Warning lights
shall be famished for low oil pressure, high water
temperature, low voltage, body weight limit, hydraulic
oil level, and hydraulic oil temperature. All of the above
controls in addition to the chassis engine ignition,
parking brake control, and gutter broom speed control
shall be centrally mounted in cab. An anti -crank device
shall be provided to prevent re-engagement of starter
while engine is running. Swept mileage recorder shall be
provided. A clean and clear maintenance "cat walk"
shall be provided for engine access. Hopper "UP"
warning light and buzzer to be included and operational
when either the cab or sweeper ignition switch is on.
Blower:
Bidder will list type of blower to be famished, how it

will be driven, and what are the advantages of the type
bid. Blower impeller shall be 31 inches in diameter
minimum constructed of Hardox 500 or equal steel and
balanced within 1.5 grams. Blower housing to be lined
10 gauge anti -abrasion steel with inspection ports. The
purchaser has demonstrated various types of vacuum
sweepers and has determined that a minimum impeller
fan speed of 3,400 RPM is required to effectively convey
the vast majority of sweepings into the debris hopper.
State engine RPM required to generate an impeller fan
speed of 4,000 RPM and 20,000 CFM. Impeller exhaust
port is to be sealed and air is to be exhausted horizontally
through a sound suppressed roof tunnel vent. Blower
drive system: To permit long life and lower cost of
operation, the entire blower shall be guaranteed for 5
years. Warranty shall include all components between
the engine flywheel and the blower. Warranty shall
cover all components, including normal wear items, such
as, but not limited to, belts, pulleys, bearings, shafts,
fluid couplings, clutches, seals, etc. Warranty shall
include all parts and labor for a period of 5 years.
Manufacturer shall be financially responsible for all
repairs, parts and labor. No pro -rating of hour
limitations acceptable. Vendors shall submit warranty
statements from the manufacturer with their bids. A
gear -box if used shall have a fluid level sight glass and

easily accessible fill port. Blower exhaust port shall be
hinged for simple cleaning, and inspection. Opening of
exhaust port shall not require the removal of more than 2
bolts.
Air System:
A separate air tank for all sweeping air components shall

protection device that will not allow the chassis air
pressure to drop below 85 PSI from operation or an air
loss from the sweeper. System to include a self purging
air dryer/ 5 micron filter. All Air lines to be marked for

Hydraulic

Component

A centrifugal dust separator shall be supplied inside the

exceeds 5 working days a loaner sweeper will be
supplied to the city. If a sweeper is not available the
vendor will pay the City $500 per day.

to the lowest bidder, the factors used to justify the awards

The Board reserves the right to reject any and/or all bid or
bids thereof and to waive any irregularities or
informalities.
Payment for each unit will be processed upon delivery of
the unit to the City of South Bend.
Number of Units: One (1) more or less.
Price Guarantee: The successful bidder shall guarantee the bid price for a minimum of 12
months from the bid award date to the City of South Bend. The City

Bucher Municipal North America, Inc. ("Bucher Municipal") warrants to the original end user purchaser ("You" or "Your")
that the Bucher -branded sweeper product (referred to herein as a "Product") will be free from material defects in
workmanship and materials under normal use and service during the first two thousand (2,000) hours of operation or
for a period of twenty-four (24) months from the date of purchase, whichever occurs first. Bucher Municipal further
warrants to You that with respect to Bucher -branded spare parts, each such spare part which is installed in a Product in
connection with a valid warranty claim will be free from material defects in workmanship and materials under normal use
and service for a period of twelve (12) months from the date of installation.
The following are additional terms applicable only to the particular Product or parts identified (and subject to all other
terms in this Limited Warranty):
HOPPER WARRANTY STATEMENT - Truck Mounted V, R & ES - Range Sweepers
Bucher Municipal hereby certifies that the sweeper's Debris Hopper Body, excluding normal wear and tear and
excluding inlet wear tubes, plates and screens, shall be warranted against rust perforation, corrosion
perforation and any failure of the internal hopper protective coatings for the lifetime of the sweeper,
provided the sweeper is continuously owned by the original purchaser, and provided the warranty is
requested in the customer's bid specifications. Coverage includes parts and labor in accordance with the
terms in the Limited Warranty. This additional limited warranty is not transferable.
IMPELLER/SUCTION FAN DRIVE SYSTEM WARRANTY STATEMENT - Truck Mounted V & R -Range
Vacuum Sweepers
Bucher Municipal hereby certifies that the sweeper's impeller/suction fan drive system, excluding the auxiliary
engine and suction fan, shall be warranted for five (5) years from the original date of purchase of the
sweeper, provided the sweeper is continuously owned by the original purchaser and provided the
warranty is requested in the customer's bid specifications. Coverage includes all components between
the engine flywheel and the suction fan. The warranty shall also cover normal wear items such as belts,
pulleys, bearings, shafts, fluid couplings, clutches and seals. Coverage includes parts and labor in
accordance with the terms in the Limited Warranty. This additional limited warranty is not transferable.
There is NO WARRANTY in cases of damage in transit, negligence, abuse, abnormal usage, misuse, accidents, normal
wear and tear, damage due to environmental or natural elements, failure to follow Bucher Municipal's instructions, or
improper installation, storage or maintenance. This Limited Warranty does not cover chassis or engines, and Bucher
Municipal's sole obligation with respect to such chassis and engines shall be limited to assigning or transferring to You
any written warranty extended to Bucher Municipal by the manufacturer thereof, to the extent such warranty may
reasonably be assigned or transferred. However, Bucher Municipal does not guarantee that the manufacturer of such
chassis or engines will comply with any of the terms of its warranty. This Limited Warranty does not cover any of the
following: (1) parts designated by Bucher Municipal as consumable items; (2) fuel, hydraulic fluid, antifreeze and other
lubricants used in connection with maintenance or warranty work; or (3) downtime incurred in connection with
maintenance or warranty work. Improper or incorrectly performed maintenance or repair that causes damage to the
Product will void this Limited Warranty. This Limited Warranty applies only to original equipment supplied by
Bucher Municipal and to genuine Bucher -branded spare parts. Without limiting any of the foregoing, there is NO
WARRANTY for unauthorized parts or materials, or for any equipment failure caused by the use of such unauthorized
parts or materials including, without limitation, non -OEM brooms, hoses and filters. Bucher Municipal must have
received Your properly completed warranty registration card within fifteen (15) days of Your purchase of the Product or
the Limited Warranty shall not apply and there shall be NO WARRANTY. All Limited and Extended Warranties are
non -transferable.
The availability of relief under this Limited Warranty is conditioned on: (a) Your delivery of written notice (as
described below) of the defect within thirty (30) days after Your discovery of the defect (or if the defect is discovered
during delivery to You, within 24 hours after such delivery), which notice must include a detailed written report describing
(i) the problem, (ii) the circumstances under which the problem was discovered, and (iii) any additional relevant
information; and

(b) defective part(s) being held by You until disposal or return has been authorized in writing by Bucher Municipal. For the
avoidance of doubt, if any of the foregoing conditions are not met, then there is NO WARRANTY.
Bucher Municipal's sole and exclusive obligation under this Limited Warranty (and Your sole and exclusive remedy) shall
be, upon prompt written notice by You to Your authorized Bucher Municipal dealer of any claim or breach during the
applicable warranty period, to either, at Bucher Municipal's option, repair or replace without charge, any Product or
Bucher Municipal -branded part found by Bucher Municipal to be covered by and in breach of this Limited Warranty.
Notice of any warranty claim or request for warranty service should be sent to the Bucher Municipal -authorized dealer that
sold the Product to You, or any other person authorized by Bucher Municipal in writing. It is Your responsibility to perform
the recommended maintenance at the intervals outlined in the applicable Product manual or in accordance with other
written instructions provided by Bucher. You will be responsible for transportation of the Product to and from an
authorized dealer's place of business.
Any assistance Bucher Municipal provides to or procures for You outside the terms, limitations or exclusions of this
warranty will not constitute a waiver of the terms, limitations or exclusions of this Limited Warranty, nor will such
assistance extend or revive the warranty.
Bucher Municipal will not reimburse You for any expenses incurred in repairing or replacing any defective Products,
except for those incurred with Bucher Municipal's prior written permission.
This warranty gives You specific legal rights, and You may also have other rights which vary from state to state.
THE EXPRESS WARRANTIES SET FORTH HEREIN ARE EXCLUSIVE AND IN LIEU OF ALL OTHER EXPRESS
WARRANTIES. BUCHER MUNICIPAL HEREBY DISCLAIMS AND EXCLUDES ALL OTHER EXPRESS AND IMPLIED
WARRANTIES INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR
FITNESS FOR A PARTICULAR PURPOSE. TO THE EXTENT THAT APPLICABLE LAW PROHIBITS THE EXCLUSION
OF IMPLIED WARRANTIES, THE DURATION OF ANY APPLICABLE IMPLIED WARRANTY IS LIMITED TO THE
PERIOD SPECIFIED FOR THE EXPRESS WARRANTY CONTAINED HEREIN. Any oral or written description of the
Products is for the sole purpose of identifying the Products and is not an express warranty. No person is authorized to
make any other warranty or assume for Bucher Municipal any liability not strictly in accordance with this Limited Warranty.
Prior to using or permitting use of the Products, You agree to determine the suitability of the Products for the intended use
and further agree to assume all related risk and liability. You agree that Bucher Municipal has no post -sale duty to warn
You or any other party about any matter.
YOU AGREE THAT BUCHER MUNICIPAL WILL NOT BE LIABLE FOR INCIDENTAL, CONSEQUENTIAL, INDIRECT
OR SPECIAL DAMAGES. BUCHER MUNICIPAL'S AGGREGATE LIABILITY WITH RESPECT TO ANY PRODUCT AND
THIS CONTRACT SHALL BE LIMITED TO THE MONIES RECEIVED BY BUCHER MUNICIPAL FOR THE PRODUCT(S)
GIVING RISE TO THE CLAIM. Some states do not allow the exclusion or limitation of incidental and consequential
damages, so the above limitation or exclusion may not apply to You.
Whenever possible, each provision of this Limited Warranty shall be interpreted in such manner as to be effective and
valid under applicable law, but if any portion is deemed invalid or unenforceable, the remaining portions shall still be
enforceable.
