AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND,
INDIANA, AMENDING CHAPTER 2, ARTICLE 8, SECTION 2-121 OF THE
SOUTH BEND MUNICIPAL CODE CLARIFYING HOLIDAYS FOR
CITY OFFICERS AND EMPLOYEES
STATEMENT OF PURPOSE AND INTENT
In those years that New Year's Day falls on a Saturday or Sunday it is appropriate for the
Board of Works to designate a preceding or succeeding weekday to provide the paid holiday for City
officers and employees. This may affect the allocation of nine designated holidays per year in those
years that New Year's Day falls on a Saturday. This Ordinance is intended to clarify that such a
substitution shall not affect the nine (9) day designated holiday maximum.
It is also appropriate to expand the choice ofnon-designated holidays from which officers
and employees are entitled to select one day. Accordingly, this Ordinance adds Election Day and
Easter Monday to the list of non-designated holidays. It also provides substitutes for the non-
designated holidays of Christmas Eve and the Day after Christmas in those years when Christmas
falls on a Saturday or Sunday.
BE IT THEREFORE ORDAINED by the Common Council of the City of South Bend,
Indiana as follows:
Section I. Chapter 2, Article 8, Section 2-121 of the South Bend Municipal Code be and
hereby is amended to read as follows:
(a) Officers and employees shall receive nine (9) designated holidays as approved by the
Board of Public Works and one (1) additional nondesignated holiday. An officer or
employee may choose to substitute this additional holiday for one (1) of the following
nondesignated holidays:
Martin Luther King Day
President's Day
Columbus Day-Observed
Christmas Eve~or the preceding Frida when Christmas falls on a Sunday
Day after Christmas, or the following_Monday when Christmas falls on a Saturday
Employee's Birthday
Easter Monday
A religious holiday of the employee's choosing
Election Day (Primary or General)
(b) In those years when New Year's Day falls on a Saturday the Board of Works shall
substitute the,preceding day as the designated holiday and such holiday shall be treated as
if it fell in the same year as January 1 of the New Year for purposes of the nine (91 designated
holidays of subpart (a).
(b~ ~ This section does not apply to sworn police officers or firefighters.
Section II. This Ordinance shall be in full force and effect from and after its passage by the
Common Council and approval by the Mayor.

Chapter 2, Article 8, Section 2-121 of the South Bend Municipal Code Clarifying
Holiday for City Officers and Employees
Dear Council President White:
This letter is in reference to this proposed ordinance amending and clarifying Section 2-121 of
the South Bend Municipal Code with respect to holidays for City employees.
Because the Christmas holiday will fall on Saturday during calendar year 2004, (and New
Year's Day will fall on Saturday in 2005), the language with respect to floating holidays will need to
be clarified so that the day prior to or subsequent to the designated holiday can be taken as the
employee's floating holiday. Three other proposed floating holidays have also been added: Primary
or General Election Day and Easter Monday.
Another issue has to do with the designation of the appropriate day off for the January 1, 2005
holiday which falls on a Saturday. Typically, the holiday falling on a Saturday would be taken the
day before, but that would then place the holiday on December 31, 2004 resulting in ten (10) holidays
for 2004 and only eight (8) for 2005. The rewritten subsection (b) addresses that issue.
I will attend the Council's committee meeting as well as the council session on October 27,
2003, to present the ordinance. Please let me know if you have any questions.
