' 2 /6-'7 AN ORDINANCE AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED AT 1950 RIDGEDALE ROAD IN THE CITY OF SOUTH BEND, INDIANA BE IT ORDAINED by the Common Council of the City of South Bend, Indiana: SECTION 1. Ordinance No. 4990-68, as amended, which ordinance is commonly known as the Zoning Ordinance of the City of South Bend, Indiana, be and the same hereby is amended in order that the zoning classification of the following described real estate in the City of South Bend, St. Joseph County, State of Indiana: Ridgedale Nursing Home All of Lot 572 of the recorded Plat of Twyckenham Hills, Section "J" and all of Lot 652 of the recorded Plat of Twyckenham Hills, Section "K", EXCEPTING therefrom as follows, viz: Beginning at the Northwest corner of Lot 572, Twyckenham Hills, Section "J", thence South 240 feet along Westerly Line of Lots 572 and 652; thence East 115 feet parallel to the North Line of said Lot 572 and 652 to a point 115 feet Easterly from the place of beginning on the said North line of Lot 572; thence Westerly 115 feet along the said North line to the place of beginning, containing 6. 155 acres. be and the same is hereby established as B Residential A Height and Area. SECTION II. This rezoning shall be subject to the Petitioner filing a Final Site Development Plan addressing screening, pursuant to Section 21-99 of the Municipal Code, for the land along the West Boundary beginning at the setback line going south for approximate length of 215 feet, and screening and/or an earthen berm along the North boundary on Ridgedale Road beginning at its most Western point to the East for approximately 150 feet. SECTION III. This ordinance shall be in full force and effect from and after its passage by the Common Council, approval by the Mayor, and legal publication. JOSEPH COUNTY, IN Executive Director Room 1140 County-City Building South Bend, Indiana 46601 (219) 284-9571 September 17, 1991 The Honorable Common Council City of South Bend County-City Bldg. - 4th Floor South Bend, IN 46601 RE: A proposed ordinance and site development plan of Holladay Corp., Ridgedale Nursing to zone from 93" Residential, "A" Height and Area to "B" Residential , "A" Height and Area, property located at 1950 Ridgedale Road, City of South Bend, as tabled. - APC #1411-91 Dear Council Members: The above referenced ordinance and site development plan of Holladay Corp. , Ridgedale Nursing was legally advertised July 5, 1991 and July 6, 1991. The Area Plan Commission at its public hearing on September 17, 1991 , took the following actione Upon a motion by John DeLee, being seconded by Willie Morgan and carried, the proposed ordinance and site development plan of Holladay Corp., Ridgedale Nursing to zone from "B" Residential , "A" Height and Area to "B" Residential, "A" Height and Area, property located at 1950 Ridgedale Road, City of South Bend, as tabled, is sent to the Common Council with a favorable recommendation as tendered. The proposed laundry facility will be located in an area that should not have an impact on nearby residential uses. PLEASE NOTE that the Ordinance has been amended by the petitioner and is different than that used for the Common Council 's first reading. The amended Ordinance was the Ordinance legally advertised and heard by the Area Plan Commission. The deliberations of the Area Plan Commission and points considered in arriving at the above decision are shown in the minutes of the public hearing, and will be forwarded to you at a later date to be made a part of this report. EXISTING LAND USE: The property contains a nursing home. SURROUNDING LAND USE AND ZONING: Located to the north across Ridgedale Road are single-family residences zoned "A" Residential; to the east across _Ironwood Road is a church. zoned "A" Residential ; to the south are single-family residences zoned "A" Residential; and to the west are single-family residences zoned "A" Residential and an office building zoned "B" Residential . ACCESS,: Access to the site is from Ridgedale Road and Ironwood Road. WATER SOURCE/SEWAGE DISPOSAL: Water and sewer are available to the site. DRAINAGE: The drainage has been addressed by the petitioner. SITE DATA: The total site to be rezoned is 6.15 acres. Of that, the buildings will occupy 1 .35 acres or 22 percent of the site; the parking and drives will occupy 3.78 acres or 61 .5 percent of the site; and 1 acre or 16.5 percent of the site will remain as open space. ENVIRONMENTAL DATA: A check of the Agency's maps indicates that no public wells, wetlands, flood or environmental hazard areas are present . SITE PLAN: The site plan is final .
