ORDINANCE NO. ga 4.4 1-9
AN ORDINANCE TO VACATE THE FOLLOWING
DESCRIBED PROPERTY: West Jefferson Street from the west
line of Lot #32 running east to 40 feet east of the east
line of Lot #29 in Ann Thomas Subdivision to the City of
South Bend, Indiana, for a distance of approximately 270 feet.

STATEMENT OF PURPOSE AND INTENT
•
Pursuant to Indiana Code Section 36-7-3-12, the Common
Council is charged with the authority to hear all petitions
to vacate public ways or public places within the City.
The following Ordinance .vacates the above described
public property.
NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF
THE CITY OF SOUTH BEND, INDIANA, as follows:
SECTION I. The Common Council of the City of South Bend
having held a public hearing on the petition to vacate the
following property:
West Jefferson St. from the west line of lot 32 running east
to a point 40 feet east of the east line of lot # 29 in Ann Thomas
Subdivision of a part of Bank Outlot 74 in the Town now City of South
Bend, St. Joseph County, Indiana. •
hereby determines that it is desirable to vacate said property.
SECTION II . The City of South Bend hereby reserves the
rights and easements of all utilities and the Municipal City of
South Bend, Indiana to construct and maintain any facilities,
including, but not limited to, the following: electric, telephone,
gas, water, sewer, surface water control structures and ditches,
within the vacated right-of-way, unless such rights are released
by the individual utilities.
SECTION III . The following property may be injuriously
or beneficially affected by such vacating:
Lots 10, 11 , 12, 13, 14, 15, 16, 17, 18 and 19 in Thomas Sub-
division of a part of Bank Outlot #74 and lots 29, 30, 31 , 32, 33, 34,
and 35 in Ann Thomas Subdivision of a part of Bankout #74 all in the
Town now City of South Bend, St. Joseph Co. , Indiana.
SECTION IV. The purpose of the vacation of the real property
is to:Construct a new museum for the Northern Indiana Historical Society
Inc. to be used for the enrichment and education of the citizens of this
area on their cultural heritage.
SECTION V. This ordinance shall be in full force and effect
from and after its passage by the Common Council and approval by the
Mayor.

#32 RUNNING E. TO 40 FEET EAST OF THE EAST LINE OF LOT 29
Dear Members of the Council :
In accordance with Municipal Code Section 18-53 .8 , a favorable
recommendation is being submitted to the Common Council concerning the
Vacation Petition filed by the Northern Indiana Historical Society,
Inc. , 808 West Washington Street , South Bend, Indiana, which indicated
Mr. Lloyd S . Taylor, 808 West Washington Street, South Bend, Indiana, as
the Contact Person, to vacate the following property:
West Jefferson Street from the west line of Lot #32 running
east to 40 feet east of the east line of Lot #29 in Ann Thomas
Subdivision to the City of South Bend, Indiana, for a distance
of approximately 270 feet
For your information, a Public Hearing concerning the Vacation Petition
as filed was held by the Board of Public Works on February 3 , 1992 .
Mr. Lloyd S. Taylor, 808 West Washington Street , South Bend, Indiana,
made a presentation to the Board and spoke in favor of the vacation.
There was no one present to speak against this vacation and the Board
did not receive any written objections . A copy of the minutes of the
Public Hearing is attached for your information.
Therefore, based on favorable recommendations received by the Board from
various departments and bureaus and favorable comments made at the
Public Hearing, the Board of Public Works submits to you a favorable
recommendation on the vacation of the above referred to street .

PROPERTY: WEST JEFFERSON STREET FROM THE WEST LINE OF LOT #32
RUNNING EAST TO 40 FEET EAST OF THE EAST LINE OF LOT #29 IN ANN
THOMAS SUBDIVISION TO THE CITY OF SOUTH BEND, INDIANA, FOR A
DISTANCE OF APPROXIMATELY 270 FEET.
