RE: Alley/Street Vacation – 1212 Poplar St., East/West Alley from Euclid Ave. to North/South
Alley between Euclid Ave. and Cleveland Ave.
(Preliminary Review)
Dear Mr. Chodzinski:
The Board of Public Works, at its October 13, 2020, meeting, reviewed comments by the Engineering
Division, Community Investment, Fire Department, Police Department, and the Solid Waste Division.
The following comments and recommendations were submitted:
Community Investment stated the alley is not adjacent to the petitioner’s property, a requirement of IC
36-7-3-12 regarding the right to petition for the vacation of a public right-of-way. The Board also noted
that the vacation process closes the alley and divides the property between the adjacent property owners.
Since the petitioner is not an adjacent property owner, if the alley were vacated, the petitioner would no
longer be able to use it to access their garage which was the stated purpose of the vacation request.
Therefore, the Board of Public Works submitted an unfavorable recommendation for the vacation of
this alley vacation.
Please contact Permit Department at (574) 235-9254 prior to picking up your radius map. You
will need a radius map showing properties within 150’ of the proposed vacation for your petition to the
Common Council. Once you pick up the radius map, proceed to the City Clerk’s office for your alley
vacation packet.
