GAMMON Approved and sired by me i -C t-,r,,- 2 r g 1, fty04-- Mayor SUBSTITUTE BILL NO. 9-91 ORDINANCE NO. % . 1- g\ AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AMENDING CHAPTER 4, ARTICLE 4, SECTION 4-60 OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND COMMONLY KNOWN AS "TRANSIENT MERCHANTS" . STATEMENT OF PURPOSE The City of South Bend in conjunction woth the Chamber of Commerce, passed Ordinance No. 8086-90 which amended the rules and regulations addressing transient merchants within the City. Surrounding communities have passed similar legislation in an attempt to set reasonable and enforceable regulations of such activity. During this Holiday Season however, it has been brought to the City's attention that vendors who wish to sell Christmas trees and wreaths for a limited period of time, are currently required to pay the sum of one thousand dollars ($1, 000. 00) if they desire to sell trees for more than fourteen (14) total days. The City believes that the current licensing fee amount creates an undue hardship, and therefore believes that an amendment to the fee is in order. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AS FOLLOWS: Section I. Chapter 4 , Article 4, Section 4-60 (f) of the Municipal Code of the City of South Bend, Indiana is hereby amended to read as follows: (f) License Fees (1) The license fees for transient merchants shall be as follows: (i) Three hundred fifty dollars ($350.00) for proposed business operations of three (3) consecutive days or less. (ii) Five hundred dollars ($500. 00) for proposed business operations of more than treee (3) consecutive days but less than fourteen (14) total days of operation. (iii) One thousand dollars ($1, 000. 00) for proposed business operations of more than fourteen (14) total days, but less than one (1) year of any licensing year. (iv) Thirty dollars ($30. 00) for proposed business operations during the months of November and/or December, which only sell live and/or natural Christmas trees and/or live and/or natural wreaths. Section II. Committee currently charges businesses who wish to sell Christmas of the Whole trees or Christmas wreaths during this Holiday Season. The following Bill would amend the fee amount to a Stephen Luecke total of fifteen dollars ($15. 00) for such business First District operations. All other licensing requirements would remain in full force and effect. It is my understanding Donald Niezgodski that such amendments would be necessary since the City Second District Administration has elected to issued licenses under this Section as opposed to Sec. 4-38 in addressing open William Soderberg air business.
