AN ORDINANCE AMENDING THE ZONING ORDINANCE
FOR PROPERTY LOCATED AT THE SOUTHWEST CORNER
OF PORTAGE ROAD AND THE EAST-WEST TOLL ROAD
IN THE CITY OF SOUTH BEND, INDIANA
BE IT ORDAINED By the Common Council of the City of South Bend,
INDIANA:
SECTION I . Ordinance No. 4990-68, as amended, which ordinance is
commonly known as the Zoning Ordinance of the City of South Bend, Indiana,
be and the same hereby is amended in order that the height and area
classification as established by Ordinance 8174-91 for the following
described real estate in the City of South Bend, St . Joseph County, State
of Indiana:
That part of the Northwest Quarter of Section 27, Township 38 North,
Range 2 East , German Township, City of South Bend, Indiana which is
described as: Beginning at the Southwest Corner of SEction Nine (9) of
"Portage Place Apartments" as recorded by Document Number # 8513274 in the
Office of the Recorder of St . Joseph County, Indiana; thence N. 00°-O1 '-30"
E. . 601 .86 ft . (Record, 602.33ft .) ; thence along the South Right-of-Way of

RE: A proposed ordinance initiated by the Area Plan Commission to change from "D
Height and Area to "F" Height and Area; property located at the southwest corner
of Portage Road and the East-west Toll Road, City of South Bend - APC #1441-92
Dear Council Members:
The above referenced ordinance and site development plan of Area Plan Commission
was legally advertised February 6, 1992 and February 8, 1992. The Area Plan
Commission at its public hearing on February 18, 1992, took the following action:
Upon a motion by Harold Means, being seconded by Gerry Phipps and unanimously
carried, the proposed ordinance initiated by the Area Plan Commission to change
from "D" Height and Area to "F" Height and Area; property located at the
southwest corner of Portage Road and the East-west Toll Road, City of South Bend
is sent to the Common Council with a favorable recommendation. The proposed
ordinance would simply correct an administrative error made in the past when this
property was rezoned.
The deliberations of the Area Plan Commission and points considered in arriving
at the above decision are shown in the minutes of the public hearing, and will be
forwarded to you at a later date to be made a part of this report.
Attached, for your consideration in the review of this matter, is a copy of the
Area Plan Commission's Staff Report .

STAFF REPORT February 10, 1992
Area Plan Commission 1441-92
Location: southwest corner of Portage Road and the East-west Toll Road
City of South Bend
REQUESTED ACTION: This is an APC initiated petition intended to
correct an error that was made when Ordinance
#8174-91 was adopted by the Common Council .
The subject property should have been
reclassified as "F" Height and Area, rather
than "D" Height and Area, when it was rezoned
to "D" Light Industrial for mini-warehouses.
The petition was originally submitted as "D"
Height and Area; however , it was amended to
"F" Height and Area prior to the Area Plan
Commission's public hearing of February 19,
1991. The Common Council inadvertently passed
the original ordinance rather than the amended
one. The subject ordinance would simply
correct this error by establishing this
property as "F" Height and Area.
