Such compensation may "not be changed in the year for which it is fixed, nor may it be reduced below the amount fixed for the previous year". The following Ordinance establishes the annual compensation for Mayor of the City of South Bend and for the South Bend City Clerk for calendar year 2004. NOW, THEREFORE, be it ordained by the Common Council of the City of South Bend, Indiana, as follows: Section I. The annual compensation for the Mayor of the City of South Bend in calendar year 2004 shall be and hereby is established at $87,460.00. Section II. The annual compensation for the South Bend City Clerk in calendar year 2004 shall be and hereby is established at $47,378.00. Section III. If any one or more of the provisions contained in this ordinance shall for any reason be held to be invalid, illegal, or unenforceable in any respect, such invalidity, illegality or unenforceability shall not affect any other provision hereof, and this ordinance shall be construed as if such invalid, illegal or unenforceable provision was not contained therein. Section IV. Two of the ordinances are necessary to appropriate monies to defray expenses of several City departments and designated funds, the third is necessary in order to levy. taxes and fix the rate of taxation for the purpose of raising revenue, and the fourth and fifth sets forth the annual compensation for non-bargaining employees, Mayor and City Clerk of the City for the year 2004.
