AN ORDINANCE OF THE COMMON COUNCIL OF
THE CITY OF SOUTH BEND, INDIANA, AMENDING
CHAPTER 2, ARTICLE 4, SECTION 2-13 OF THE MUNICIPAL
CODE TO ESTABLISH A CITY BUILDING DEPARTMENT AND TO
ENUMERATE CERTAIN FUNCTIONS OF THAT DEPARTMENT
STATEMENT OF PURPOSE AND INTENT
The purpose of this ordinance is to amend Chapter 2 of the
Municipal Code to establish a City Building Department and to
enumerate some of the duties of that department. With the approval
of the City and County Councils, the City of South Bend and St.
Joseph County consolidated their building departments effective
January 1, 1992. The consolidated department will be operated by the
City of South Bend under the supervision of the Consolidated Building
Board. It is appropriate, therefore, that the City Building
Department be established as a separate department from the. Code
Enforcement Department.
NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL, OF THE CITY
OF SOUTH BEND, INDIANA, AS FOLLOWS:
SECTION I . Chapter 2, Article 4, Section 2-13 of the South Bend
Municipal Code is amended to read as follows:
ARTICLE 4, EXECUTIVE DEPARTMENTS
Sec. 2-13. Departments established.
(A) The following executive departments are established to
perform administrative functions required to fulfill the needs of the
City' s citizens:
( 1) Administration and Finance Department;
( 2) Law Department;
( 3) Public Works Department;
( 4) Police Department;
(5) Fire Department;
( 6) Public Parks Department;
(7) Economic Development Department;
( 8) Code Enforcement Department;
( 9) Building Department.
(B) In addition to functions statutorily provided, the
administrative functions of the departments of the City shall be as
follows:
(1) Administrative and Finance Department:
(a) Administrative matters;
(b) Fiscal matters;
(c) Purchasing;
(d) Personnel;
(e) License issuance;
( f) City parking garages and parking lots.
(2) Law Department:
(a) Collection of overdue accounts receivable
(b) Self insurance.
(f) Waterworks;
(g) Vehicle maintenance.
( 4) Police Department.
( 5) Fire Department.
( 6) Public Parks Department:
(a) Parks;
(b) Zoos;
(c) Greenhouses;
(e) Playgrounds;
(f) Cemeteries;
(g) Recreation programs and centers.
(7) Economic Development Department;
(a) Redevelopment;
(b) Community development;
(c) Housing programs;
(d) Youth Services Bureau;
(e) Human Rights Commission;
( f) Economic development;
(g) Planning.
( 8) Code Enforcement Department:

( 9) Building Department:
(a) Building inspections and permits;
(b) Enforcement of building codes;
(c) Zoning inspection and enforcement;
(d) Board of Zoning Appeals administrative support.
(e) Building trade licensing/registration testing and
enforcement.
(C) A department head may establish, abolish or consolidate
offices, divisions and bureaus within his department to permit the
proper and efficient operation of that department, subject to
availability of appropriated funds within the department and the
approval by the Mayor.
(D} A department head may supervise and coordinate the boards,
commissions, authorities, departments, offices, divisions and bureaus
within his department except where prohibited by State law.
(E) No department head may delegate his duty to administer and
supervise his department, to issue rules or regulations as prescribed
by law, or to have the ultimate responsibility for the proper
performance of the duties and functions vested in his department.
(F) Each department shall exercise such powers and perform such
duties and functions as are prescribed by law and as are directed by
the Mayor.
SECTION II.
This ordinance shall be in full force and effect from and after
its passage by the Common Council and approval by the Mayor.

Dear Mr. Luecke:
I am attaching for filing a proposed ordinance which would amend
Chapter 2 of the South Bend Municipal Code by establishing a City
Building Department and enumerating some of the functions of that
department. For the past many years, the City Building Department
function has been carried out by the Department of Code Enforcement.
With the approval of the City and County Councils, the City of South
Bend and St. Joseph County consolidated their building departments
effective January 1, 1992. This consolidated department will be
operated by the City of South Bend under the supervision of the
Consolidated Building Board. It is appropriate, therefore, that the
City Building Department be established as a separate department.
The purpose of this ordinance is merely to administratively
effectuate action that has already been taken by the Council. Your
support and favorable action on this ordinance is requested.
