ORDINANCE No. Passed by the Common Council of the City of South Bend, Indiana September 22, 20 03 Attest: City Clerk Attest: _ ~- ~~ V i c e President of Common Council Presented by me to the Mayor of the City of South Bend, Indiana September 23, 20 03 City Clerk Approved and signed by me september 23 2D 03 T Mayor ORDINANCE NO. ~ `I S S -©3 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AMENDING CHAPTER 20, ARTICLE 1, SECTION 20-18 OF THE SOUTH BEND MUNICIPAL CODE TO INCREASE OVERTIME PARHING FINES STATEMENT OF PURPOSE AND INTENT For several years the fines for overtime parking violations within the City of South Bend have been set at five dollars ($5.00) if paid within fourteen (14) days of notice and fifteen dollars ($15.00) after the expiration of fourteen (14) days. The daily parking rate in municipally owned garages has increased from three dollars ($3.00) to five dollars ($5.00) per day, and therefore, it is appropriate to readjust the fine for overtime parking violations. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA as follows: Section I. Chapter 20, Article 1, Section 20-18 of the South Bend Municipal Code shall be amended to read as follows: The owner or operator who has been notified of a violation of the parking regulations as herein provided, may, within fourteen (14) days after being notified, answer at the office of the Ordinance Violation Bureau to the charge of such violation as set forth in such notice and pay a prescribed fee of 63 ten dollars ($10.00) in settlement of the offense or charge, or twen , dollars ,$20.00) after the expiration of fourteen (14) days. An acceptance of the payment of the fee and the authority by the Clerk shall be deemed complete satisfaction for the violation and the violator shall be given a receipt which so states. Section II. LUECKE, MAYOR COMMUNITY 8L ECONOMIC DEVELOPMENT August 20, 2003 Ms. Karen White President, South Bend Common Council 41h Floor, County-City Building South Bend, IN 46601 Re: Ordinance to Increase Overtime Parking Fines Dear Ms. White: Attached for consideration by the South Bend Common Council is an Ordinance amending Chapter 20, Article 1, Section 20-18 of the South Bend Municipal Code to increase from five dollars ($5.00) to ten dollars ($10.00) the prescribed fine for overtime parking if the fine is paid within fourteen (14) days. The Ordinance further provides that the prescribed fine will increase from fifteen dollars ($15.00) to twenty dollars ($20.00) if the fine is paid after fourteen days of notice. This fine increase is necessary due to the passage of time since the fines were last increased. It is further necessary because the municipally owned daytime parking garage fees have been increased and the new daily rate is five dollars ($5.00). If the parking garage fees and overtime parking fines are the same, it may encourage non- compliance with prescribed parking time limits. We hope that the Common Council will find that this overtime parking fine increase is in the best overall interest of the City and its citizens(to be effective 01/01/04). I will attend the Common Council's committee meeting to discuss this Ordinance and answer any questions you may have. I will also present the Ordinance to the Common Council at its public hearing.
