AND WILLIAM RICHARDSON DR. AND AT THE EAST END OF WILLIAM RICHARDSON DR. IN THE CITY OF SOUTH BEND, INDIANA BE IT ORDAINED By the Common Council of the City of South Bend, INDIANA: SECTION I . Ordinance No. 4990-68, as amended, which ordinance is commonly known as the Zoning Ordinance of the City of South Bend, Indiana, be and the same hereby is amended in order that the zoning classification of the following described real estate in the City of South Bend, St . Joseph County, State of Indiana: Two Parcels located in Section 21 , Township 38 North, Range 2 East, City of South Bend, St. Joseph County, Indiana described as Lots 4 and 5, Toll Road Industrial Park, Section 3; Lot 6 Toll Road Industrial Park, Section 4; Lots 14 and 15 Toll Road Industrial Park, Section 6; and that part of Lot 18B Gainey's Replat of Lot 20, Section 1 and Lot 18, Section 6, Toll Road Industrial Park, located north of a line described as: Beginning at the southeast corner of Lot 17 Toll Road Industrial Park, Section 6: thence N 88°-53'-36" East 930.91 feet , parallel to the north lot line of said Lot 18B, to the east lot line of said Lot 18B, also being the east line of said Section 21 . be and the same is hereby established as "D" Light Industrial , "A" Height and Area. The Area Plan Commission at its public hearing on June 16, 1992, took the following action: Upon a motion by Jerry Phipps, being seconded by Willie Morgan and unanimously carried, the proposed ordinance initiated by the Area Plan Commission to zone from "A" Residential, "A" Height and Area to "D" Light Industrial, "A" Height and Area, property located at the southwest corner of William Richardson Dr. and Ralph Jones Dr. and at the east end of William Richardson Dr., City of South Bend is sent to the Common Council with a favorable recommendation. The deliberations of the Area Plan Commission and points considered in arriving at the above decision are shown in the minutes of the public hearing, and will be forwarded to you at a later date to be made a part of this report. Johnson RSJ:sr Attachment CC: Area Plan Commission Serving: South Bend, Lakeville, New Carlisle, North Liberty, Roseland & St. Joseph County, IN - • STAFF REPORT May 11 , 1992 Area Plan Commission 1449-92 Location: the southwest corner of William Richardson Dr. and Ralph Jones Dr. and at the east end of William Richardson Dr. City of South Bend REQUESTED ACTION: This is an Area Plan Commission initiated rezoning to establish "D" Light Industrial , "A" Height and Area zoning on six lots within the Toll Road Industrial Park. The lots have recently been annexed into the City. EXISTING LAND USE: The property is currently vacant . SURROUNDING LAND USE AND ZONING: This property is surrounded by "D" Light Industrial and "M" Manufacturing zoning to the north, south, and west , all within the existing or future phases of the Toll Road Industrial Park. To the east are single-family homes zoned "R" Residential . ACCESS: Access to the site is from William Richardson Dr. and Ralph Jones Dr. WATER SOURCE/SEWAGE DISPOSAL: Water and sewer are available to the sites. DRAINAGE: SITE DATA: The total site to be rezoned is approximately 47 acres. ENVIRONMENTAL DATA: A check of the Agency's maps indicates that no public wells, wetlands, flood or environmental hazard areas are present . SITE PLAN: A site plan is not required for rezonings that are initiated by the Area Plan Commission.
