"c2 71-9 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AMENDING ORDINANCE NO. 8228-91 RELATING TO THE REGISTRATION OF BUILDING CONTRACTORS STATEMENT OF PURPOSE AND INTENT The purpose of this ordinance is to amend Ordinance No. 8228-91, governing the registration of building contractors in the City of South Bend, by changing its effective date from July 1, 1992 to November 1, 1992. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AS FOLLOWS: Section I. Section III of Ordinance No. 8228-91 is amended to read as follows: Section III. This Ordinance shall be in full force and effect eri-Jtlp-1;-1992; on November 1, 1992, and from and after its passage by the Common Council and approval by the Mayor. Section II. Zoning Administrator June 2, 1992 Mr. Stephen Luecke President, South Bend Common Council 4th Floor County-City Building South Bend, IN 46601 Dear Mr. Luecke: I am attaching for filing a proposed ordinance which would amend Ordinance 8228-91, governing the registration of building contractors in the City of South Bend, by changing its effective date from July 1, 1992 to November 1, 1992. Ordinance No. 8228-91 was passed by the Common Council on November 25, 1991. It provides for registration of all building contractors within the City by July 1, 1992. It also provides a timetable for implementation of a licensing procedure for building contractors that takes place between January, 1993 and July 1, 1994. The change that is proposed in this ordinance would delay the registration of building contractors for four months, from July 1, 1992 to November 1, 1992. It would not, however, affect the timetable that was contained in the ordinance relative to the institution of licensing procedures at later specified dates. The reasons that I am requesting this delay in implementation of the registration of building contractors are as follows: 1 . As you know, the St. Joseph County and City of South Bend Building Departments were consolidated in January of this year. I now have twice as many people working out of the same area on the 7th Floor of the County-City Building. We had anticipated that new, larger quarters would be found for the Building Department shortly after the consolidation occurred. Unfortunately, that has not yet happened. '>r .r, • • Mr. Stephen Luecke June 2, 1992 Page 2 When the ordinance relating to building contractor registration was passed, it was anticipated that the Building Department would hire an additional person to handle the increased paperwork required by the registration process. We have not yet been able to contemplate the hiring of this additional person, since we do not have adequate space for the people that we currently have Additionally, the registration process will require a computerized system if it is to be done properly. We have not had the City' s computer system installed in the Building Department, since this, is an expensive process and since we contemplate moving in the near future. Accordingly, since the current Building Department has neither the space, the personnel nor the computers to begin the registration process, we are requesting a four-month delay in implementation, which will, hopefully, give us adequate time to resolve these problems. 2. The summer is, for obvious reasons, the busiest time in the Building Department. Totally apart from our current problems, it would be far easier to set up and implement a registration or licensing process for contractors during the winter months. Since registrations and licenses are to be annual, it would certainly be easier for the Building Department to handle the renewal process in November than it would be to handle the same process in July. Delaying the process to November, therefore, is also better from a planning and time allocation point of view. 3. I currently have a meeting scheduled with the Home Builders Association and intend to discuss, in addition to other matters, the idea of extending the building contractors' registration and licensing county-wide. This would, of course, require County Council action. However, if I can obtain the support of the Home Builders Association, it is quite possible that, by November, legislation could be in place that would permit county-wide registration. I would think that a combined registration would be attractive to the Home Builders Association members and would be in harmony with the philosophy and benefits of the consolidated Building Department. An opportunity to do a combined registration would be another benefit in delaying the registration to November. For the reasons stated above, it is my belief that delaying the effective date of Ordinance No. 8228-91 to November 1, 1992 is in the best interest of the City and the consolidated Building Department.
