AN ORDINANCE TO VACATE THE FOLLOWING
DESCRIBED PROPERTY the first north south alley
east of north Walnut Street running north from
West Washington Street.
STATEMENT OF PURPOSE AND INTENT
Pursuant to Indiana Code Section 36-7-3-12, the Common
Council is charged with the authority to hear all petitions
to vacate public ways or public places within the City.
The following Ordinance vacates the above described
public property.
NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF
THE CITY OF SOUTH BEND, INDIANA, as follows:
SECTION I . The Common Council of the City of South Bend
having held a public hearing on the petition to vacate the
following property:
the first north-south alley east of N. Walnut Street,
from the north right-of-way line of W. Washington Street
to the south right-of-way line of the first east-west
alley north of W. Washington Street, for a distance of
approximately 198' and a width of approximately 14 feet.
Part situated in Commissioner's Subdivision of Bank
Outlot 79 in the City of South Bend, Indiana.
hereby determines that it is desirable to vacate said property.
SECTION II . The City of South Bend hereby reserves the
rights and easements of all utilities and the Municipal City of
South Bend, Indiana to construct and maintain any facilities,
including, but not limited to, the following: electric, telephone,
gas , water, sewer, surface water control structures and ditches,
within the vacated right-of-way, unless such rights are released
by the individual utilities.
SECTION III . The following property may be L IViA ' /4'

Lots 9 & 10 Rockafeller's Addition
Lots 103-106, A, B & C Commissioner's Sub of Bank Outlot 79
SECTION IV. The purpose of the vacation Of the real property
is to:
allow for replatting these lots into one lot as a site for
new duplex and triplex apartment buildings
SECTION V. This ordinance shall be in full force and effect
from and after its passage by the Common Council and approval by the
Mayor.

R.O.W. LINE OF THE 1ST E/W ALLEY N. OF W. WASHINGTON STREET
Dear Members of the Council:
In accordance with Municipal Code Section 18-53 .8, a favorable
recommendation is being submitted to you concerning the Vacation
Petition as filed by Mr. Jeffrey V. Gibney, 914 Lincolnway West,
South Bend, Indiana, on behalf of Ms. Michele Dobski Shidler, West
Washington Homes Partnership, 914 Lincolnway West, South Bend,
Indiana, to vacate the following property:
The First North/South alley East of N. Walnut Street,
from the North right-of-way line of W. Washington
Street to the South right-of-way line of the First
East/West alley North of W. Washington Street, for a
distance of approximately 198 ' and a width of
approximately 14 feet. Part situated in Commissioner' s
Subdivision of Bank Outlot 79 in the City of South
Bend, Indiana.
For your information, the Board of Public Works, at their meeting
held today, received favorable recommendations regarding this
vacation from the Fire Department, Police Department, Department of
Economic Development, Area Plan Commission and the Engineering
Department.
Therefore, based on this information, the Board of Public Works
submits to the Common Council a favorable recommendation on the
above referred to vacation.
