Statement of Purpose and Intent This ordinance sets forth the monetary aspects of the tentative agreement reached between the City Negotiating Team and the Teamster's Negotiating Team on Thursday, June 25, 1992, which was later ratified on June 29, 1992 by the members of Teamster Local Union No. 364. This Ordinance would approve the monetary amounts of the ratified wage and benefit package, which are believed to be in the best interest of the City. Accordingly, the intent of this Ordinance is to fix the maximum salaries and wages for all City employees represented by the International Brotherhood of Teamsters of America, Local Union No. 364, for calendar years 1993, 1994, and 1995. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, as follows: Section I. Scope of Coverage. This Ordinance shall determine all issues of compensation for all employees for the City of South Bend, Indiana, represented by Teamsters Local Union No. 364 affiliated with the International Brotherhood of Teamsters of America, hereinafter referred to as the "Teamster Local Union No. 364,"in the following operational units: Bureau of Building Maintenance Bureau of Cemeteries Bureau of Sewers Bureau of Solid Waste Bureau of Streets Bureau of Traffic and Lighting Bureau of Waste Water Bureau of Water Works Century Center Department of Parks and Recreation Division of Equipment Services Police Department Section II. Maximum Compensation. A. Pay periods for all such employees shall be made in accordance with Section 2-118 of the Municipal Code of the City of South Bend. Teamster Salary Ordinance Page 6 Section III. Bonus Payment. A. The City shall pay a bonus to each eligible employees. The bonus shall be paid by separate check and shall have normal withholdings deducted therefrom. The bonus checks shall be paid as follows: Bonus Eligibility Date Date Paid 1st Bonus Payment January 1, 1993 2d pay period in of$500.00 January of 1993 2nd Bonus Payment June 15, 1993 1st pay period in of$500.00 July of 1993 3rd Bonus Payment January 1, 1994 2d pay period in of$300.00 January of 1994 B. All eligible employees who have worked within the sixty (60) calendar days preceding the first eligibility date of January 1, 1993 shall be paid the full bonus payment. All who are employees on subsequent eligibility dates,whether active, on leave or on layoff, will be prorated on a calendar month basis over the twelve (12)full months preceding the eligibility date with the employee receiving credit for 1/12 bonus payment for each month worked. For purposes of prorating, an employee shall be given credit if he or she works eleven (11) days in the month. For purposes of paying bonuses, worked means actually worked as an employee during the time period referred to and paid vacation and paid holidays shall count as days worked in the month total. Employees who are probationary employees as of the eligibility date shall be paid a bonus when he or she becomes a seniority employee. In such cases, the bonus shall be paid with his or her first full pay check received as a seniority employee. Section IV. Holidays. A. Each such employee shall have ten (10) holidays per calendar year. The following nine (9)holidays are recognized by the Employer: New Year's Day Veteran's Day Good Friday Thanksgiving Day Memorial Day Day after Thanksgiving Fourth of July Christmas Day Labor Day The remaining one (1) holiday shall be as selected by the individual employee, with the consent of the City, from the following: Christmas Eve New Year's Eve Easter Monday Martin Luther King's Birthday Columbus Day Employee's Birthday Election Day(Indiana Primary or General Election Day) B. Employees represented by Teamster Local Union No. 364 shall receive their regular hourly rate of pay including any premiums for each of the ten (10) holidays. An Employee working a five 8-hour day workweek shall receive 8 hours pay for each of the ten (10) holidays,providing he or she has worked the regularly scheduled day before and after the holiday unless officially excused. An employee working a four 10-hour day work-week shall receive 10 hours pay for each of the ten (10) holidays, providing he or she has worked the regularly scheduled day before and after the holiday unless officially excused. Regular employees will be entitled to holiday pay if the holiday falls within the first thirty (30) days of absence due to illness or non-occupational injury or within the first (6) months of absence due to occupational injury. F. Probationary employees and temporary employees shall not be entitled to holiday pay. Section V. Vacations. A. All employees represented by Teamster Local Union No. 364 who were employed by the City on or before December 31, 1986, and have been employed continuously since, shall have the following schedule for 1993, 1994, and 1995: Years of Continuous Service Hours of Vacation 1-4 years 80 5-7 years 96 8-11 years 120 12-15 years 144 16-19 years 160 20-24 years 208 25 + years 224 B. All other employees represented by Local Teamster Union No. 364 shall have the following vacation schedule for 1993, 1994, and 1995: Length of Continuous Service Hours of Vacation 0-1 year 0 1-2 years 40 3-4 years 80 5-10 years 96 11-15 years 120 16-19 years 136 20-24 years 160 25 + years 176 C. All other requirements related to vacations shall be addressed in the Agreement entered into between the City of South Bend and Teamster Local Union No. 364 as further addressed in Section VI herein. D. Vacations will be paid in accordance with Section 1-20 of the Municipal Code of the City of South Bend. Section VI. Other Monetary and Fringe Benefits Incorporated by Reference. All provisions of the Agreement between the City of South Bend, Indiana and the Teamsters Local Union No. 364 effective January 1, 1993 through December 31, 1995, concerning any issue of wages and/or compensation, including but not limited to provisions concerning overtime, standby, call-back, shift differential,vacations, insurance, and other related monetary items are incorporated herein and made a part hereof as if set forth herein in their entirety. Two copies shall be kept on file and made available for public inspection during regular business hours in the Office of the City Clerk, 4th Floor County City Building, South Bend, Indiana. Section VII. Effective Date. Horton July 25, 1992 Members of the Common Council 4th Floor County-City Building South Bend, Indiana 46601 RE: Substitute Bill No. 55-92-Teamster Employees Salary and Wage Ordinance Dear Council Members: On behalf of the City Negotiating Team, I am pleased to introduce Substitute Bill No. 55- 92 which establishes maximum salaries and wages for Teamster Employees of the City of South Bend for calendar years 1993, 1994, and 1995. As you are aware, a joint negotiating team made up of administrative and legislative members successfully negotiated a three (3) year wage and benefit package with the Teamster Negotiating Team. Members of the City Team included: John E. Leszczynski, Thomas L. Bodnar, Catherine A. Hubbard, Jeffery Jankowski, Stephen Luecke, Ann Puzzello,Eugene Ladewski, Kathleen Cekanski-Farrand. The overall terms of the Three Year Agreement are as follows: a one thousand dollar($1,000) bonus in 1993 payable $500 dollars in January and $500 in June of 1993; in 1994 a three hundred dollar ($300) bonus payment payable in January and a fifteen cent base hourly increase; and in 1995 a fifteen cent base hourly rate increase on January 1, 1995 and a fifteen cent base hourly increase effective July 1, 1995. Adjustments were also made with regard to holidays. Specific agreement was reached with regard to eight hour and ten (10) hour employees. Nine (9) specific holidays are recognized by the City with the individual employee selecting one additional holiday from a list of eight(8)days jointly selected by the Teamsters and the City. Adjustments with regard to insurance benefits will also be incorporated within the Bargaining Agreement.
