GAMMON Approved and signed by me 1 c; zggd. °"�`- Mayor A 7 if • r y 4 3 L f Ordinance No, (9308- AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA TO CREATE A RIVER BEND HISTORIC PRESERVATION DISTRICT STATEMENT OF PURPOSES AND INTENT TO ESTABLISH an Historic Preservation District, to be known as the River Bend Historic Preservation District, with such uses as permitted in Section 21-36,1 of the Municipal Code of the City of South Bend, such District having been recommended by the Historic Preservation Commission of South Bend and St. Joseph County, for the purpose of preserving the architectural, historical, and cultural significance and educational value of the described area. NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of South Bend, Indiana as follows: SECTION 1. Ordinance No, 4990-68, as amended, which ordinance is commonly known as the Zoning Ordinance of the City of South Bend, Indiana, be and the same hereby is amended in order that the zoning classification of the following described real estate in the City of South Bend, St. Joseph County, State of Indiana: Part of the East 1/2 of the Southwest 1/4 of Section 1 Township 37 North, Range 2 East, Portage Township, City of South Bend described as follows: Beginning at a point on the North R/W line of Bartlett Street Approximately 66 feet North of the Northeast corner of Lot 30 as shown on the plat of Rockstroh's 2nd Addition to the City of South Bend, said point also being at the intersection of the projected West R/W line of St. Joseph Street with Said North R/W line of Bartlett Street. Thence South along the West R/W line of St. Joseph Street and its projection to its point of intersection with the projected South R/W line of Hammond Place. Thence East along the South R/W line of Hammond Place and its projection to the Northwest corner of Lot 44 as shown on the plat of Hammond & Whitcomb's Addition to the City of South Bend. Thence South approximately 138 feet along the West line of said Lot 44 and its projection to the South R/W line of the first East-West alley North of Navarre Street. Thence East along the South R/W line of said alley to the Northwest corner of Lot 55 in said Hammond & Whitcomb's Addition. Thence South along the West line of said Lot 55 and its projection to the South R/W line of Navarre Street. Thence East along said South R/W line of Navarre Street to the Northeast corner of Lot 57 in said Hammond & Whitcomb's Addition. Thence Southerly along the East line of Lots 57, H, K, and L in said Hammond and Whitcomb's Addition and the West R/W line of the first North-South alley West of Riverside Drive, to the point of intersection with a projected line which runs from the Northwest corner of Lot 6 in said Hammond and Whitcomb's Addition Southeasterly to a point on the West R/W line of Riverside Drive, 10 feet Northeasterly of the Southwest corner of said lot 6. Thence Southeasterly along said previously described line, and its projection to the East R/W line of Riverside Drive as shown on said plat of Hammond and Whitcomb's Addition. Thence Northerly along the East R/W line of Riverside Drive to its intersection with the North R/W line of Bartlett Street. Thence West along the North R/W line of Bartlett Street to the point of beginning. BE AND THE SAME IS HEREBY established as an Historic Preservation district with such uses as permitted in Section 21-36.1 of the Municiple Code of the City of South Bend, Indiana, and shall be designated the River Bend Historic Preservation District. JOSEPH COUNTY, IN Executive Director Room 1140 County-City Building South Bend, Indiana 46601 (219) 284-9571 August 26, 1992 The Honorable Common Council City of South Bend County-City Bldg. - 4th Floor South Bend, IN 46601 RE: A proposed ordinance initiated by the Common Council of the City of South Bend, establishing the River Bend Historic Preservation District - APC #1463-92 Dear Council Members: The above referenced ordinance of Common Council was legally advertised on August 13, 1992. The Area Plan Commission at its public hearing on August 25, 1992, took the following action: Upon a motion by Harold Means, being seconded by Charles Landesman and carried, the proposed ordinance initiated by the Common Council of the City of South Bend, establishing the River Bend Historic Preservation District is sent to the Common Council with an unfavorable recommendation. The deliberations of the Area Plan Commission and points considered in arriving at the above decision are shown in the minutes of the public hearing, and will be forwarded to you at a later date to be made a part of this report. Attached, for your consideration in the review of this matter, is a copy of the Area Plan Commission's Staff Report. Sincerely, Richard S. The proposed district is bounded by Bartlett street on the north , the St .Joseph • River on the east , Marion Street on the south and St .Joseph Street on the west . The proposed district contains 80 primary structures. Surrounding land uses include the Leeper Park well field to the north, zoned "A" Residential; a nursing home zoned "B" Residential to the south; and Memorial Hospital and single and multi-family residences zoned "C" Commercial and "B" Residential to the west . A check of the • agency's maps indicates that no wetlands, flood or environmental hazard areas are present . However, a public well field is located directly to the north of the proposed district .
