MEMORANDUM OF UNDERSTANDING AMENDMENT NO. 2
This Amendment No. 2 to the Memorandum of Understanding is effective as of August 1, 2020,
by and between The Trustees of Indiana University (“IU”) and the City of South Bend, Indiana, and its
Venues, Parks, and Arts Department, by and through its Board of Park Commissioners (the “City”), (each
a “Party” and collectively referred to hereinafter as the “Parties”).
WITNESSETH:
WHEREAS, IU and City are Parties to that certain Memorandum of Understanding (“MOU”),
effective August 1, 2018, between the City of South Bend and The Trustees of Indiana University for
IU’s use of City’s Leeper Park Tennis Center located at 837 N. Lafayette Blvd., South Bend, Indiana,
46616, which MOU has been amended and extended by that certain Amendment No. 1 to the
Memorandum of Understanding, effective August 1, 2019 (the MOU as amended from time to time is
hereinafter collectively referred to as the “Original MOU”); and,
WHEREAS, the Original MOU expired on July 31, 2020; and,
WHEREAS, IU and City wish to extend the Term of the Original MOU beyond that which is set
forth therein.
NOW, THEREFORE, in consideration of the foregoing promises, the mutual obligations
contained herein, and other good and valuable consideration, the receipt and sufficiency of which are
hereby acknowledged, IU and City hereby agree as follows:
1. The Term of the Original MOU shall be extended for an additional one (1) year,
beginning August 1, 2020, and expiring July 31, 2021.
Except as amended herein, all of the terms and provisions of the Original MOU shall remain in
full force and effect.
IN WITNESS WHEREOF, the Parties have executed this Amendment No. 2 to the Memorandum
of Understanding.
