AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF
SOUTH BEND ESTABLISHING A NEW SCHEDULE OF RATES
AND CHARGES FOR SERVICES RENDERED BY THE CITY OF
SOUTH BEND WATER WORKS AND THE AMENDING OF CHAPTER
17, ARTICLE 4, SECTIONS 17-45, 17-46, 17-47, 17-48
OF THE SOUTH BEND MUNICIPAL CODE.
STATEMENT OF PURPOSE AND INTENT
The City of South Bend, Indiana last established a schedule of rates
and charges for services rendered by the Water Works by Ordinance No.
6829-80 which was passed on September 5, 1980.
Municipal Consultants, a financial consultant to the Board of Water
Works Commissioners, has carefully reviewed the City's rates and charges
and has determined that an increase in such rates and charges is
necessary to continue to provide quality services.
The Common Council has determined that in order to meet the
statutory requirements as provided in Section 8-1.5-3-8, it is necessary
that the rates and charges be increased for services rendered by the
Water Works of the City of South Bend. The Council further notes that
such rate and charge increases will require the approval of the Utility
Regulatory Commission of the State of Indiana.
NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF
SOUTH BEND, INDIANA, as follows:
Section I. Chapter 17, Article 4, Section 17-45 and Section
17-45.1 of the South Bend Municipal Code shall be, and hereby are,
amended to read as follows:
Sec. 17-45 Water Works Rates and Charges.
There shall be and are hereby established for the use of and
the services rendered by the Water Works System of the City of
South Bend, the following rates and charges, based upon the use
of water and facilities furnished by said Water Works System:

(c) Metered water charges shall be the larger of the minimum charges
of subparagraph b and the rate charges of subparagraph a of this
Section. In the case of multiple meters under a single billing
entity, the charges shall be computed for each meter separately,
not the summation of usage.

fg} (f) Temporary Service +minimum-eharge-payable-in-advanee}
Temporary service where metered shall be calculated upon the
registration of a meter or meters installed at the approved meter
rates. In such cases as the Utility may deem it impractical to
install a meter for temporary service, there shall be a minimum
monthly charge of twelve dollars ( $12.00) . If the water
consumption computed at approved rates is known to be in excess
of the twelve dollars ($12.00) minimum charge, an authorized
agent of the Utility shall have the right to estimate said water
usage and the estimated usage shall be billed at the approved
meter rates.

Section II. Chapter 17, Article, 4, Section 17-46 of the South Bend
Municipal Code shall be, and hereby is, amended to read as follows:
Sec. 17-46 Late Payment Penalty.
All bills for water services not paid within five (5) days from
the due date thereof, as stated in such bills, shall be subject
to a collection or deferred payment charge of ten-pereent-f6%+
six percent ( 6%)-en-the-total-amount-past-due of the current
monthly bill.
Section III. Chapter 17, Article 4, of the South Bend Municipal Code
shall be, and hereby is, amended to add a new section, Section
17-46.1, which shall read as follows:
Sec. 17-46.1 Suburban Rates.
Customers with water service outside the City Limits shall incur
an added surcharge of twenty per cent (20%) of the rates and
charges of Sections 17-45 and 17-46.
Section IV. Chapter 17, Article 4, of the South Bend Municipal Code
shall be, and hereby is, amended to add a new section, Section 17-46.2,
which shall read as follows:
Sec. 17-46.2 Sales for Resale Rates.
Customers such as suburban utilities, reselling water to their
customers, shall incur a surcharge of forty-four percent (44%)
added to the rates and charges of Section 17-45.
Section V. Chapter 17, Article 4, of the South Bend Municipal Code
shall be, and hereby is, amended to add a new section, Section 17-46.3
which shall read as follows:
Sec. 17-46.3 Bulk Sales Charges.
Sales to tanker trucks or other bulk users shall be metered or
estimated where metering is not feasible and the rates and
charges of Section 17-45 shall apply except there shall be a
minimum charge of twelve dollars ($12.00) per month.
Section VI. Chapter 17, Article 4, Section 17-47 of the South Bend
Municipal Code shall read in its entirety as follows:
Sec. 17-47 Non-Recurring Charges.
(a) Deposits:
Security deposits, payable upon service initiation and refundable
upon service termination, shall be no more than one-sixth (1/6)
of the estimated annual bill for each meter size. Governmental
entities shall be exempt from deposits.
(b) Tap Charges:
The charge for main taps shall be at the Utility's cost.
Section VII. Chapter 17, Article 4, Section 17-48 of the South Bend
Municipal Code shall read in its entirety as follows:
Sec. 17-48 Authorization and Two Year Rate Review.
(a) This tariff has been authorized by City of South Bend Common
Council Ordinance # and by the Indiana Utility
Regulatory Commission pursuant to Cause #
approved.
(b) The Common Council shall review at least every two (2) years from
the effective date of this ordinance, all rates and charges of
the Water Works. The Water Utility Director shall file all
pertinent data needed by the Common Council, on or before June
1st of the year in which the notes and charges shall be reviewed.
Section VIII. All ordinances in conflict with the provision of this
Ordinance are repealed upon this Ordinance becoming effective as set
forth in Section IX herein.
Section IX. This Ordinance shall be in full force and effect from
and after its passage by the Common Council, approval by the Mayor
and legal publication, provided however that this Ordinance shall not
become effective unless and until the schedule of rates and charges
set forth herein have been approved by the Indiana Utility Regulatory
Commission, and all existing rates and charges of Ordinance No.
6829-80 shall continue in effect until such approval.

Dear Councilmen:
On September 9, 1992, Bill No. 79-92 establishing a new
schedule of rates and charges for services rendered by the City of
South Bend Water Works was filed with the Common Council.
Subsection (c) of Section 17-47, entitled Other Non-Recurring
Charges, incorrectly stated the charges currently being assessed
for such non-recurring charges. The rates currently being assessed
are laid out in the attached ordinance and are found in subsection
(c) of Section 17-47 titled Other Non-Recurring Charges.
