A RESOLUTION OF THE SOUTH BEND BOARD OF PARK COMMISSINERS
AUTHORIZING STAFF TO EFFECT TRANSACTION
WHEREAS, the City of South Bend Board of Park Commissioners (the “Park Board”) exists
and operates pursuant to Ind. Code 36-10-3 and 36-1-4; and
WHEREAS, the Boys and Girls Club of St. Joseph County (BGCSJC”) will offer an
eLearning Program (the “Program”) for k-12 grade students while in-person instruction is not
available at local schools; and
WHEREAS, the Program will assist with technology and internet access, while providing
participants with supervision and assistance with online class assignments; and
WHEREAS, BGCSJC programming will be woven into the eLearning schedule and
complement the school curriculum; and
WHEREAS, the BGCSJC desires to engage with the City of South Bend Venues, Parks
& Arts Department (“VPA”) to hold Program sessions at the City’s Martin Luther King
Jr. Community Center, 1522 W. Linden Avenue, South Bend, IN 46628, and the Charles
Black Community Center, 3419 W. Washington Street, South Bend, IN 46628, and have
VPA staff participate in providing Program support; and
WHEREAS, to carry out the intentions of the City and the BGCSJC with respect to this
Project, the parties will need to negotiate and memorialize in a Memorandum of Understanding
(“MOU”) documenting the responsibilities of each entity; and
WHEREAS, to carry out the intentions of the MOU, the Park Board desires to allow the
Executive Director of VPA to execute the MOU related to the Project on its behalf.
NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND BOARD OF PARK
COMMISSIONERS AS FOLLOWS:
1.The Park Board authorizes Aaron Perri, Executive Director of the City’s Venues,
Parks & Arts Department to negotiate the terms of the MOU with the BGCSJC and
to effectuate any documents required to effectuate the transactions contemplated by
the MOU.
2.This Resolution shall be in full force and effect upon its adoption by the City of
South Bend Board of Park Commissioners.

Indiana held on August 17, 2020, at the Howard Park the O’Brien Center Board Room, 219 S. St.
Louis Blvd, South Bend, Indiana 46617.
