HomeMy WebLinkAbout9445-03 Approving the Redevelopment Commission's creation of the South Side Economic Development Project DistrictORDINANCE No. s<45~3 Passed by the Commo~t Council of the City of South Bend, Indiana August 25, 20 03 Attest: Attest: Presented by me to the Mayor of the City of South Bend, Indiana August 26, 20 03 Ciry Clerk President of Common Council Ciry Clerk Approved and signed by me AllQll s t 2 8 20 4~- G~ t~Gt-~---- M~~ ORDINANCE NO. ~ S d3 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA APPROVING THE SOUTH BEND REDEVELOPMENT COMMISSION'S CREATION OF THE SOUTH SIDE ECONOMIC DEVELOPMENT PROJECT DISTRICT AND THE SOUTH SIDE ECONOMIC DEVELOPMENT PROJECT DISTRICT DEVELOPMENT PLAN FOR THE PURPOSES OF UTILIZING SALES TAX INCREMENT FINANCING ("BYTE") STATEMENT OF INTENT AND PURPOSE Indiana Code § 36-7-26 establishes a mechanism for the creation of an economic development project district and to utilize sales tax increment financing within said district for the purposes of redeveloping and stimulating the economic development within those areas declared to be stagnant or deteriorating. Consistent with the procedures prescribed by Ind. Code § 36-7-26, the South Bend Redevelopment Commission ("Commission"), by its declaratory Resolution No. 1955 adopted March 21, 2003 ("Declaratory Resolution") has heretofore declared the area described more particularly in Section II of this Ordinance to be stagnant and deteriorating within the meaning of Ind. Code § 36-7-26 and has further determined that economic conditions in said area are beyond remedy and control by existing regulatory processes because of the substantial public financial commitments necessary to encourage significant increased in economic activities in said area, and economic development of said area can be accomplished only by a coordinated effort of local and state governments. The Commission has designated the area described in Section II of this Ordinance as the "South Side Economic Development Project District" and, in accordance with Ind. Code § 36-7-26- 16 has submitted its Declaratory Resolution No. 1955 determining to create the South Side Economic Development Project District ("BYTE District") together with the South Side Economic Development Project District Development Plan ("ST1F District Development Plan")and supporting data to the State Board of Finance for its approval. Consistent with Ind. Code § 36-7-26-16, the State Board of Finance at its meeting of July 21, 2003, has reviewed the Commission's Declaratory Resolution No.1955 and supporting data, and has approved the Commission's Declaratory Resolution No. 1955 and the STIF District Development Plan subject to certain modifications. By its Resolution No. 1990 adopted August 22, 2003 ("Confirming Resolution"), the Commission has heretofore ratified and confirmed its Declaratory Resolution No. 1955 and the STIF District Development Plan subject to the modifications requested by the State Board of Finance, thereby designating the STIF District, approving the STIF District Development Plan as modified by the State Board of Finance and determining to create said STIF District for purposes of utilizing sales tax increment financing. The City of South Bend is eligible to utilize the benefits of Ind. Code § 36-7-26 which dedicates STIF funds for use in the redevelopment and economic development of an economic development project district designated by the South Bend Redevelopment Commission. In accordance with Ind. Code § 36-7-26-20, the determination of the Commission to create an economic development project district, after approval by the State Board of Finance, must be approved by ordinance of the legislative body of the City. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, as follows: SECTION I. Resolution No. 1990 adopted by the South Bend Redevelopment Commission on August 22, 2003 ratifying and confu-rning its declaratory Resolution No. 1955 and the STIF Development Plan, as modified by the State Board of Finance, and determining to create the South Side Economic Development Project District is hereby approved. SECTION II. An economic development project district to be known as the "South Side Economic Development Project District" ("BYTE District") shall be and hereby is established in accordance with Ind. Code § 36-26-1 and the boundaries for the STIF District are established as set forth below: South Side Economic Development Project District A parcel land being a part of Section 30, and a part of Section 29, and a part of Section 25, all in Township 37 North, Range 2 East and Range 3 East, City of South Bend, Centre Township, Penn Township and Portage Township, St. Joseph County, Indiana and being more particularly described as follows: Beginning at the intersection of the North right-of--way line of Ireland Road and the East right-of--way line of Middleboro Street extended North; thence South to the South right-of--way line of Ireland Road; thence Westerly and Southwesterly to the East right-of--way line of Ironwood Road; thence South along said East right- of-way line of Ironwood Road to the North right-of--way line of the U.S. 20 Bypass (St. Joseph Valley Parkway); thence West to the Westright-of--way line of Ironwood Road; thence North along said West right-of--way line to the Southerly right-of--way line of Ireland Road; thence Northwesterly and Westerly along said South right-of- way line of Ireland Road to the Northwest corner of Lot 8 Scottsdale Addition A; thence South along the West line of Scottsdale Addition A to the Northright-of--way line of said U.S. 20 Bypass; thence East along said North right-of--way line to the Page -2- West right-of--way line of York Road, thence Southeasterly along said West right-of- way line to the South right-of--way line of said U.S. 20 Bypass; thence West along said Southright-of--way line to the most Northwesterly corner of Lot 185 Scottsdale Addition D; thence South along the West line of said Addition D to the Northeast corner of Lot 2 Frame's Jackson Road Minor Subdivision; thence West along the North line of said Frame's Jackson Road Minor Subdivision and its projection West to the East line of the Fairington Apartments; thence South along said East line to the South right-of--way line of Jackson Road; thence West along said South right-of--way line to a point 850 feet West of the centerline of Miami Street; thence North to the South right-of--way line of said U.S. 20 Bypass; thence West along said South right- of-way line to a point 1400 feet East of the centerline of Michigan Street; thence North to the North right-of--way line of said U.S. 20 Bypass; thence East along said North right-of--way line to the East right-of--way line of Fellows Street; thence Northeasterly and North along said East right-of--way line of Fellows Street to the Southwest corner of Lot 11 Widener's 1~` Addition; thence East along the South line of said Widener's 1~` Addition to the Southeast corner of Lot EE in Hildred's Replat; thence North along the East line of said Lot EE to the South right-of--way line of Widener Lane; thence Southeast and East along said South right-of--way line of Widener Lane to the West line of Lot 28 Widener's Replat and Minor Subdivision projected South; thence North along said West line of Lot 28 and its projection to the Northwest corner of said Lot 28; thence West to the Southwest corner of Lot 2 Erskine Plaza Minor; thence North along the West line of said Lot 2 to the Northwest corner of said Lot 2; thence East along the North line of said Lot 2 to the West right- of-way line of High Street; thence Southeasterly to the North right-of--way line of Ireland Road; thence East along said North right-of--way line of Ireland Road to the place of beginning containing 217.70 acres more or less. SECTION III. The redevelopment and the stimulation of economic development within the STIF District shall be accomplished in accordance with the STIF District Development Plan heretofore approved by the South Bend Redevelopment Commission, as modified and approved by the State Board of Finance. SECTION IV. This Ordinance shall be in full force and effect from and after its passage by the Common Council and approval by the Mayor.
