'3/3-94 • AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AMENDING ARTICLE 11 OF CHAPTER 6 OF THE MUNICIPAL CODE RELATING TO THE REGISTRATION OF BUILDING CONTRACTORS STATEMENT OF PURPOSE AND INTENT The purpose of this ordinance is to amend Article 11 of Chapter 6 of the Municipal Code by adding a provision requiring building contractors to provide a $5,000. 00 bond to the City as a part of the pre-licensing registration process. This ordinance also delays the effective date of the building contractor registration provisions to January 1, 1993. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AS FOLLOWS: Section I. Section 6-50 of Article 11 of Chapter 6 of the South Bend Municipal Code is amended by adding subsection (e) as follows: Section 6-50 Pre-licensing Registration Process. (e) Surety bond. Each applicant for registration must also provide a surety bond payable to the City in the penal sum of five thousand dollars ( $5,000. 00) , conditioned upon faithful compliance with the provisions of the building code at it relates to work performed by the applicant, and agreeing to pay all damages, costs and expenses caused by the applicant through failure to comply with such provisions. Section II . The provisions of Chapter 6, Article 11 of the Municipal Code, as amended, relating to the pre-licensing registration of building contractors, shall become effective on January 1, 1993 . Section III. Zoning Administrator October 21, 1992 Mr. Stephen Luecke President South Bend Common Council Fourth Floor, County-City Building South Bend, Indiana 46601 Re: Amendment to Chapter 6, Article 11, of the South Bend Municipal Code Dear Mr. Luecke: I am attaching for filing a proposed ordinance which would amend the provisions of Chapter 6, Article 11, of the South Bend Municipal Code relating to the registration of building contractors. There are only two changes proposed and they are as follows: 1. This ordinance adds a section to Article 11 which requires each registration applicant to provide a surety bond in the amount of $5,000.00. This bond is conditioned upon faithful compliance with the provisions of the building code as it relates to the work performed by the applicant; and 2. The enclosed ordinance also changes the effective date of code provisions relating to the pre-licensing registra- tion of building contractors to January 1, 1993 . As you know, the current effective date of the building contractor registration ordinance is November 1, 1992. We needed to move this date out at least one month in order to make the surety bond provisions effective for all registrants this year. Since it now appears that my department will be moving to a new location on or about the first of December, we are asking that the applicability of the registration provisions be delayed for one additional month, to January 1, 1993. • • Your support and favorable action on this ordinance is requested.
