The April 14, 2008 meeting of the Personnel and Finance Committee of the South Bend Common
Council was called to order by its Chairperson, Councilmember Tom LaFountain at 3:25 p.m. in
the Council's Informal Meeting Room.
Persons in attendance included Council Members Derek Dieter, Karen White, Ann Puzzello,
Others: Aladean DeRose, Assistant City Attorney; Roger Hamburg, Citizen Member; Kathleen
Cekanski-Farrand, Council Attorney; John Voorde, City Clerk
Committee Members present, Oliver Davis, David Varner

Aladean DeRose, Assistant City Attorney, spoke to comprehensive changes to the bill from the
original proposal, some of which are still under discussion. Inasmuch as what began as an
update of the fee schedule now included enforceability issues the administration asked the bill be
withdrawn. Council Member Dieter questioned the nature of the appeal process once a ticket has
been issued. He differentiated the appropriateness of appeal on a citation written by a sworn
officer from one written by a parking employee. He maintained sworn officer cites should not be
"negotiated" by the 14th floor. Council Member Varner asked if a record of disposition for cites is
kept and if so could be accessible. Council Attorney Kathleen Cekanski-Farrand said the whole
appeal process needed transparency bolstered by education and follow-up. Council Member
Rouse spoke to a disconnect from a bill's passage to enforcement calling for follow-up and
communication. Aladean DeRose promised more of both. Based on a motion by David Varner,
seconded by Oliver Davis a motion to strike prevailed. Chuck Clark, licensing director, for the
Department of Administration and Finance said all three applicants had complied with all '08 filing
protocols, thus recommended the applications be approved. Kathleen Cekanski-Farrand, Council
Attorney spoke to the need for a step by step methodical checklist as part of the application
process so the Council would know who and why was not in compliance. Chairperson
LaFountain on a motion by Council Member Oliver Davis, seconded by Council Member Varner
pass the bill to Council favorably. Citizen Member Roger Hamburg expressed views assailing the
school board's decision not to allow Hillary Clinton to speak at Washington High School.
There being no further business to come before the Committee, Councilmember Tom LaFountain
adjourned the meeting at 3:30 p.m.
