Notice of Appeal COA#2020-0302
We wish to appeal the denial of the Certificate of Appropriateness petition number
COA#2020-0302. Our appeal is in the interest of relocating the Navarre Cabin, which is now in
its 4th location due to neighborhood development and the expansion of the North Pumping
Station. Its new permanent site on the museum's campus will provide improved preservation
and security for the cabin, increased safety for visitors, and expanded educational outreach and
benefit to the public.

Dear Mr. Harding, Ms. Erickson, et al --
The Commissioners, at the regularly scheduled monthly Historic Preservation Commission meeting on June
15, 2020 denied approval of Certificate of Appropriateness application #2020-0302, which included the
following application items:
"Cabin to be relocated to the museum's west campus as part of a larger interpretive site. See
attached plan for details.
In making its determination, the Historic Preservation Commission considered the appropriateness of the
proposed construction, reconstruction, or alteration to the preservation of the historic
landmark, specifically, and/or the Historic Preservation District, generally; the detriment to the public
welfare if the proposed construction, reconstruction, or alteration were permitted even though it is not
deemed appropriate; and the potential hardship that the denial of a certificate of appropriateness would
cause the applicant.
Following is the record from the meeting concerning your project stating why your application was denied:
Commissioner Deegan made a motion to deny COA#2020-0302. Seconded by
Commissioner Ponder.
Four in favor, two opposed.
Vote: 4—2. Motion to deny COA#2020-0302 is passed.
Commission President Gelfman clarified that, in motions for denial, Commissioners are
required to state their reasons for denial. Roll was called.

Commissioner Tiffany (NAY):
Commissioner Stalheim (AYE): I voted to deny, as I would like to see more in terms of
proposed future funding for maintenance as a way for making up for the loss in
historic tax credit resources if they are not able to be attained.
Commissioner Ponder (AYE): I voted to deny, because it goes against the Standards and
Guidelines that were read, stating, that all items shall be preserved, and it goes
against that.
Commissioner Deegan (AYE): I voted to deny, based upon the fact that it goes against the
Standards and Guidelines, and also as it betrays the educational mission and historic
value of the location.
Commissioner Downs-Krostenko (NAY):
Commissioner Gelfman (AYE): I voted to deny, because of the National historic location of
this, also the 9.7.1.1, where all items shall be preserved for this particular site, and
that moving or demolishing any historic structure that would alter the spatial or the
visual relationships in the landscape shall not be allowed.
Certificate of Appropriateness#2020-0302 is denied.
Pursuant to South Bend Municipal Code Section 21-13-02(e)(5)(B), an applicant may appeal a denial of a
Certificate of Appropriateness by the Historic Preservation Commission to the Common Council, which shall
make a final determination of the application.
The Historic Preservation Commission remains committed to preserving the built environment of the City of
South Bend and unincorporated St. Joseph County.
