Bill No. 02-20-Amending Code to Create
"Court Restricted Parking" and"Ride Sharing
Zones"
Committee Vice Chair Sharon L. McBride called the meeting to order at 4:30 p.m., but the
presenter for Bill No. 02-20 was not present at the time. Councilmember Tim Scott made a
suggestion that a motion be made to hear the presentation after the 4:50 p.m. Public Works and
Property Vacation meeting. Committee Vice Chair Sharon L. McBride made a motion to wait to
hear Bill No. 02-20 after the Public Works and Vacation Committee meeting. The motion was
seconded by Councilmember Rachel Tomas Morgan and was carried with a voice vote of four(4)
ayes. The presenter arrived shortly after the motion was made to suspend the meeting. Committee
Chair Sharon L. McBride reconvened the meeting at 4:33 p.m.
Amending Code to Create"Court Restricted Parking"and"Ride Sharing Zones"
Aladean DeRose, City Attorney for the City of South Bend Legal Department with offices on the
12th floor of the County-City Building stated this is an ordinance to add two (2) new forms of
restricted parking which is not presently contained within the municipal code. Currently,the code
allows us to create restricted parking for emergency zones, handicap parking, loading zones,

taxicab stands and bus loading zones. The two (2) new forms of Court restricted parking and
Ridesharing zones are based on, one(1) Restricted parking is based on action taken by the Board
of Public Works at a meeting last fall,and the Ridesharing zones is based on changes at Commerce
and then practice within the City. In February 2019, a report made by the U.S. Marshal's Office
with multi-faceted assessments of security and recommendations. One (1) recommendation
concerned parking for certain Court Personnel and the recommendation that they be able to park
as close as possible to the entry ways of the Court for security purposes. A petition was filed with
the Board of Public Works last fall and the Board agreed and approved this request. However, in
reviewing the code, the Legal Department determined that without a change in the ordinance, this
type of parking could not be permitted. At this point, we are asking to amend the codes to simply
allow this restricted parking around the courthouse.
Councilmember Sharon L. McBride turned the meeting over to the Council for any questions of
concerns.
Counilmember Sheila Neizgodski spoke about her concern with the lack of parking in the
downtown South Bend area right now due to the restrictive parking that is already in place in front
of the County courthouse. She also wanted to know the number of public parking spots that are
available right now in that area of the courthouse.
Councilmember Tim Scott asked for clarification on the exact areas of the additional restricted
parking and he also asked if there would be proper signage posted for the designated areas that
will be used for the restricted parking and ridesharing parking zones.
Councilmember Lori Hamann spoke about the need to have specific designated restricted parking
for rideshare and Uber or Lyft drivers in the busy downtown and Eddy Street Commons regarding
any time restrictions for the two (2) proposed restricted parking zones.
Councilmember Sharon L. McBride turned the meeting over to the public for anyone wishing to
speak either in favor or in opposition to Bill No. 02-20.
Sue Kesim, 422 Kennedy Drive, South Bend, IN spoke about how some of the restricted parking
areas that are already in place get taken up by electric vehicles and she has a concern with that.
Lisa Plencner, 1918 Beverly Place, South Bend, IN spoke about the proposed changes to the
restricted parking in proximity to the County courthouse.
Councilmember Sharon L. McBride turned the meeting back to the Council for a vote.
Councilmember Rachel Tomas Morgan made a motion to send Bill No. 02-20 to the full Council
with a favorable recommendation. The motion was seconded by Councilmember Sheila
Niezgodski and was carried with a voice vote of three (3) ayes.
